By your reasoning, someone who steals property from an American abroad can’t be prosecuted. That’s not how it works
This guy merely attempted to steal - he got 20 years:

It's like you or me eating pork in Peoria during Ramadan. Neither of us should have to worry about being extradited to Iran in order to answer for our "crimes."
