Following the process. You have to avail yourself of every administrative and judicial opportunity at a lower level before a higher level court will even entertain whether to take a case or not. Ditto for using the entirety of the NYS system prior to appealing to the Federal District Court (and, lose there, then go to the Circuit Court, and ONLY then, to the USSC).

The process is long and burdensome, but sometimes you can speed things up when there is an emergency (such as denial of basic rights, executions and other situations where irreparable harm will be done if the appeal isn’t heard). This is what happens when you have 330 million people - we haven’t expanded our courts enough to handle the volume, so it is achingly slow.
