My uninformed guess about this is that the Supreme Court has not decided the immunity case yet because at least some of the justices were waiting to see how the Trump case in Manhattan would come out and generally to look around and see what not declaring an appropriate scope of immunity would cause. Now they know and can easily predict that not allowing substantial immunity is going to cause terrific lawfare against every former president, definitely including Biden, Obama, and Clinton, each of whom could be prosecuted for many state-level felonies including homicide.

The solution to this problem is to state that the President, even when he becomes an Ex President, is immune from prosecution for anything done while in office, even if such a thing was as private as strangling his wife, with that immunity being subject to the impeachment clauses of the Constitution. Thus, for the President or ex-president to be prosecuted he would've had to commit treason, bribery, or any other high crime or misdemeanor. Then he would've had to be impeached and convicted of that crime. That's really a pretty broad group of crimes since something as horrible as strangling his wife could easily be viewed as a high crime or misdemeanor. That way the former president would have the protection of the Constitution, regardless of whether an alleged crime was viewed as within the scope of his duties as President or not. As we have seen with the impeachment prosecution of Pres. Trump, Congress can act very quickly and continue an impeachment proceeding after a President has left office. If the President is successfully impeached and convicted by the Senate, then he can be prosecuted for what ever crimes he was impeached and convicted for. Thus he does not have, "absolute immunity." Hence, this really works out to a pretty reasonable situation. If anyone here disagrees with me please post appropriate comments.

I think all the Supreme Court needs to do is call out the lack of law involved with each case. Trump has no valid misdemeanors and you can't make felonies from that. Questioning the vote count is not a crime. There are no valid signs of Jan 6 coordination and the blame is with Pelosi, by her own words. The judges disallowed exculpatory evidence, etc.

Bragg illegally withheld exculpatory information from the grand jury which indicted Trump. Of course, being Manhattan residents, they might have indicted him anyway.

The justices may realize that only Republican Presidents are in danger from rogue DAs and may worry about being perceived as partisan if they rule in favor of immunity (since a majority of them were nominated by Republican Presidents).

One thing to probably reiterate is that an impeachment proceeding must be limited to beginning while the president is in office. If we don’t specify that, then there’s the novel theory that if a president can be impeached after tenure in office, then they might take that to mean the proceedings can start anytime after holding office.

Only way to fix that is legislation that anything that happens during the president’s tenure in office, if no impeachment proceeding is begun while they’re in office, those actions are hands-off after they leave office.

If they don’t agree to it, then immediately begin impeachment proceedings for Obama, Biden, Clinton, et al, as soon as Republicans have sufficient numbers in the House to demonstrate the issue.

Clinton should be charged with murder over what he did at waco. There is no SOL on murder or manslaughter in texas. Clinton sent in military tanks to flatten the buildings where he knew the people were and burned 80 of them alive.

Obama should be prosecuted for DACA. Section 1324 title 8 makes it a federal felony to encourage illegals to live here.
