Every time the judge sustains an objection by the prosecution it sets up an avenue of appeal. Everytime a judge disallows testimony by a defense witness it sets up an avenue of appeal. Every time a judge issuea erroneous jury instructions it sets up an avenue of appeal. Every time a prosecution witness is allowed to testify as to irrelevant matters that are more prejudicial than probative, it sets up an avenue of appeal.

The state court had no jurisdiction over alleged federal crimes. Jurisdiction is always an avenue of appeal.

The question is, what avenue of appeal is not open in this case?

Trump has a right of appeal from a final judgment. Always.

This trial was filled with legal errors and direct palpable violations of rights. Dirshowitz has commented on this and suggested Trump should not waste his time on the intermediate level Court of Apeals which will be a waste of time as it has already been and instea go directly to the COA for the State. The Judge cannot somehow wall off appeal on his violations of the US Constitution or his exceeing his jurisdiction [e..g blowing right by the statute of limitations; and, trying a federal crime in his state court]. This article must be garbage.

I can't read the article and really don't want too.

I am curious how the so-called judge has done something to strip President Trump of this rights to appeal.

This sounds to me like the Times is peddling hope to Dimocrats and discouragement to Republicans.

Perhaps the Times has private assurances that the Supreme Court has agreed to participate in the scam.

In my humble opinion, the Trump team should go on offense. The judge is part of a conspiracy to violate the federal civil rights of Trump and of American voters.

Every time the judge overules and objection or makes clear taht no more objections will be tolerated he sets himself up for appeal. Every legal determination that prejudices the case is subject to appeal.

Actually I don’t believe it. Closing off many avenues of appeal seems to suggest to judge bent over backwards to let the defense have its way but I sense the judge made many motions that benefited the prosecution, not the defense. For example, Trump’s lawyer wanted a change in venue but the judge denied that motion.

You must remember, the article cited legal "experts". How can you compete with that?

Not advising the defendent of the charges against him is an avenue of appeal. Not allowing him to confront witnesses is an avenue of appeal. Not allowing him to answer to the charges communicated in closing argument is an avenue of appeal.

True but therein is the real problem now. The series of hostile appeals courts awaiting Trump. We are looking at the initial polls and contributions but they may giving us optimism that ignores the reality. If Trump has lost one or two appeals by Election day which seems likely l have doubts he will still have a cheat proof lead. It may be time for him to consider getting behind a revenge replacement because if Traitor Joe gets another term our country is truly finished.

Thank you. Some have totally written off the Constitution but it was written for redress of unjust causes. Regardless of the ‘experts’ saying all appeals have been written off, they are wrong.
