In 2020, Attorney General William Barr appointed special counsel John Durham to investigate whether federal personnel violated the law in investigating the 2016 presidential.
John Durham was an appointed and confirmed US Attorney at the time he was named special counsel. His appointment would not have violated the appointments clause.
To my knowledge Smith has never been appointed and confirmed for any government position.
This all goes back to Watergate, because it was too difficult to blow Nixon’s head off in a public street.
There is no entity in the Executive Branch that is “ independent from
Politics”. Article II creates a unitary executive. All officials are inferior to and work for the President. JFK’s AG was his damn brother!
The recourses to a President who misuses one of the many officers who serve at his pleasure and who report to him are 1) defeat in an election; and 2) trial in the Senate and removal by 2/3 of the Senators.
Other than that, the DOJ or the Agriculture Department can be as political as the Chief Executive desires.
But of course, a political DOJ (which is written into the Constitution) is not free to commit crimes, such as: appointing inferior officials without a warrant from the President, in violation of the appointments clause, &c &c.
Obviously Jack Smith is operating outside of the Constitution and outside of the law, and there is some chance - maybe not a small chance, at that, that he will be dismissed by the Supreme Court when any action by him comes before them as a case or controversy needing resolution.
