But of course, a political DOJ (which is written into the Constitution) is not free to commit crimes, such as: appointing inferior officials without a warrant from the President, in violation of the appointments clause, &c &c.
Obviously Jack Smith is operating outside of the Constitution and outside of the law, and there is some chance - maybe not a small chance, at that, that he will be dismissed by the Supreme Court when any action by him comes before them as a case or controversy needing resolution.
