Dexter Taylor, of NY, took up gunsmithing as a hobby. He never committed a crime, never hurt anyone. But following a trial in which the presiding judge said the second amendment didn't exist in her courtroom or the state of New York, Dexter was found guilty of multiple gun-related charges.

Even if we are correct in assuming that this decision will be overturned on appeal it will take time and, perhaps more importantly, money to do so. Lawfare against the Constitutionally correct but out gunned citizen exercising his rights should be resolved more easily.

Taylor manufactured a dozen untraceable firearms in violation of law. It is not a 2nd Amendment case. There are no civil rights to manufacture illegal firearms.
The RKBA of the 2nd Amendment includes the government authority to regulate firearms.
Taylor was found guilty of prohibition on unfinished frames or receivers, unlawful possession of pistol ammunition, five counts of criminal possession of a firearm, violation of certificate registration, four counts of third-degree criminal possession of a weapon, second degree possession of five or more firearms, and second-degree criminal possession of a loaded weapon.
Why does the judge need to go to prison?
During opening argument,
“Do not bring the Second Amendment into this courtroom. It doesn’t exist here. So you can’t argue Second Amendment. This is New York,” the judge said.
Without more, I cannot give an opinion. Judge Abena Darkeh may have been instructing the attorney not to argue the 2nd Amendment as it has no application to illicit weapons. It does not exist as a defense to the charges in the case. That would be correct.
It may have been intended to mean the 2nd Amendment did not apply in the State of New York which would be wrong.
Vinoo Varghese, Taylor’s attorney, attempted to argue jury nullification.
“Varghese explained that he believed the only chance of having the case go in his client’s favor was through jury nullification,” RedState reported.[...]
“I actually argued that jury nullification is allowed because there is some law from the High Court of New York that talks about lawyers who made jury nullification arguments. And basically, they said that judges shouldn’t encourage it, but they can’t prevent it. I actually made a pitch directly to Judge Darkeh to allow me to argue during nullification. She, of course, rejected that,” Varghese said.
Attorney Varghese was probably correct that Taylor's only chance was jury nullification as he had no viable legal defense.
Nothing can stop a juror from committing juror nullification, but there is no way for a juror with intent to commit juror nullification to pass voir dire without commiting perjury in the process. It would be a pro forma question for every juror, whether they will apply the law as given to them by the judge. If a seated juror expresses any intent to commit juror nullification, it is grounds to dismiss the juror. Courts can and do stop attorneys from arguing to the jury that they should ignore the applicable law.

There is no law that trumps the second amendment. Manufacturing firearms is legal because the constitution recognizes it as legal. It was a common practice in 1787.
I have read many accounts of people making their own guns. The internet is filled with examples of people making their own guns, which by the way, the ATF defines a "gun" as the receiver. There are 80% receivers for sale everywhere which allows people to make AR-15s with no serial numbers, and this has been going on for more than a decade.
Judge needs to go to prison. So do everyone involved in this prosecution. But it's New York, and it will take years for this to get through our horrible dysfunctional legal system.
