Arizona Senate passes repeal of 1864 abortion ban

The Arizona Senate passed a repeal of the state’s near-total ban on abortion on Wednesday, capping a weekslong legislative scramble to respond to the state Supreme Court’s bombshell ruling that upheld the law from 1864.

The bill, which the state House approved last week, will soon head to Democratic Gov. Katie Hobbs. Hobbs said she expects to sign the bill as early as Wednesday night.

Two state Senate Republicans — Shawnna Bolick and T.J. Shope — joined all 14 Democrats in the narrowly divided chamber in approving a repeal of the Civil War-era law that held the power to send a doctor to prison for providing nearly any kind of abortion care.

With the support of those two Republican senators, Democrats in the chamber quickly overcame procedural hurdles and swiftly moved to vote.

Bolick, in a lengthy and nuanced speech ahead of casting her pivotal vote, told several emotional stories of women who experienced major complications during pregnancy and needed care that would likely be restricted under the 1864 law — while also making clear her opposition to reproductive health groups and abortion providers like Planned Parenthood.

Donald Trump said Wednesday that an Arizona law that criminalizes nearly all abortions goes too far and called on Arizona lawmakers to change it, while also defending the overturning of Roe v. Wade that cleared states to ban the procedure.

“It’ll be straightened out and as you know, it’s all about states’ rights,” the former president told supporters and journalists after landing in Atlanta for a fundraiser. “It’ll be straightened out, and I’m sure that the governor and everybody else are going to bring it back into reason and that’ll be taken care of, I think, very quickly.”

We’re doomed, simple as that. Arizona no longer resembles the state it was when we moved here in 1996. It’s still a great place to live, but watching its independent spirit slowly evaporate is very sad. To top it off, T.J. Shape is my state senator, although hopefully not for long. 🤬

Pro-lifers should use every tool available to protect the unborn. Including that 1864 law.

Too bad Trump isn’t a committed advocate for unborn babies right to life.

Did you think Arizona - including the one of 1996 - would KEEP a total ban on abortion?

Do you think state law should reflect the desires of no more than 10% of the population?

I’m asking as someone who believes a total ban is MORAL. But morality is not the point of civil law.

What does this have to do with Trump? He’s not a dictator and unfortunately our legislators are free to vote the way they please. How is he supposed to control that? Sounds like you’d rather have Biden for another 4 years, in which case why are you here?

A total ban on abortion isn’t a bad thing. The media claims it hinders medical care for pregnant women, which is a lie that you apparently believe. The ban merely stopped elective abortions, which any conservative should applaud.

On a practical note, I knew it would be overturned eventually because the left never stops. However, I didn’t expect 2 Republicans to side with the Democrats to overturn it, one of whom is my state senator. That’s the icing on the cake for me.

This is a shame!

Pro-lifers worked unceasingly for Republican party since Roe.
They were always told - but the Supreme court ...
Now, when Trump finally changed the Supreme court to our liking, the pro-lifers are being just discarded and thrown under the bus!
For some temporary election advantage (maybe, so they think)?

He’s for states’ rights. Big whoop. A federal abortion ban isn’t the answer and neither is unfettered abortion. Moderation is the only thing that’ll work practically speaking. We got a semblance of that when Roe was overturned. Still doesn’t address your rabid TDS.

When you support a state decision to allow more abortions, then you’re pro-choice.

Trump is pro-choice.

The following dialogue was taken from the movie “Nefarious”

James a psychologist is sent to a prison to evaluate a prisoner for execution. The prisoner claims to be a demon named Nefarious. Through the course of their interaction, Nefarious tells James he (James) will commit 3 murders before leaving the prison. Nefarious tells James he had already done the first one by euthanizing his mother and now he was about to commit number two, that is where this conversation begins.

NEFARIOUS: “Say, James,
what’s Melanie up to today?

As a matter of fact,
what’s she up to right now?

She doesn’t have a clue you’re about to break up with her, does she?

Of course, you’re not gonna until you have somebody else lined up though, right?

Because you’re that kind of guy. But you already have
your sights on somebody, don’t you?

Yeah. I can smell it all the way from here. She thinks she’s doing this to maintain the relationship.

What an apt description of abortion.

You are wrong. The 1864 ban on abortion: “And every person who shall administer or cause to be administered or taken, any medicinal substances, or shall use or cause to be used any instruments whatever, with the intention to procure the miscarriage of any woman then being with child, and shall be thereof duly convicted, shall be punished by imprisonment in the Territorial prison for a term not less than two years nor more than five years: Provided, that no physician shall be affected by the last clause of this section, who in the discharge of his professional duties deems it necessary to produce the miscarriage of any woman in order to save her life.”

So anything short of saving the mother’s LIFE was banned, with prison sentences for the doctor. It went beyond “elective abortions”.

You also seem to entirely miss my point: In a democracy - or representative government - the laws cannot exceed what the people are willing to accept.

Furthermore, CIVIL law requires compromises that aren’t a part of morality, which is why the Law of Moses allowed for divorce - even though God hates divorce.

So my point is that since the overwhelming majority of Arizonans believe SOME abortions should be allowed, insisting on a total ban will result in Arizona voting to remove most or all restrictions! That is what the democrats want.

In politics, COMPROMISE is required. You cannot force others to abide by YOUR moral beliefs without FIRST convincing them!

You also miss the point. I wasn’t discussing morality, but what is politically possible without pushing Arizona into allowing ALL abortions!

I simply cannot understand why so many FReepers seem to be more upset about some foreign aid bill than the lives of America’s children. The Republican party is betraying millions of people who are pro-life but all I hear about is some Ukraine loan. Who the hell cares about what kind of money foreign countries get when there are babies to save?

I’d much rather compromise on Ukraine than on life.
