The Department of Justice’s decision this week to refuse to turn over the audio tapes of President Joe Biden’s interview with Special Counsel Robert Hur could set up a new fight between the administration and Congress.
The refusal marks the second time the DOJ has declined to provide the audio tapes to Congress, though it has turned over the transcripts of the interview.
The department first refused to turn the tapes over earlier this month, citing insufficient justification and accusing the House Republicans of political motivations—concerns the DOJ reiterated in its letter this week to the Judiciary and Oversight Committees.
“We have repeatedly invited the Committees to identify how these audio recordings from law enforcement files would serve the purposes for which you say you want them,” Assistant Attorney General Carlos Uriarte wrote to congressional investigators.

Just to clarify, their talking about the HoR sending a referral to the DOJ, recommending prosecution of the DOJ for crimes that the DOJ has committed and the HoR is expecting the DOJ to comply with the referral to prosecute the DOJ for refusing to comply with a subpoena issued by the HoR?

If there were truly GOP LEADERS, at least on the power wielding scale as their House and Senate opponents, based on the scale of corruption by the deep state at present, this time period would see a record set for subpoenas issued, and possibly some arrests by the Sergeant at Arms, and or by US Marshalls or Capitol Police.

Exactly. If they don't say, loudly, in public, that they think the FBI is full to the brim of partisan liars and that they can't be trusted, they are playing by different rules than the democrats are.
Why go through a series of requests? Ask once, them hold Garland in contempt if he doesn’t turn the documents/videos within two weeks. No need to have a fight.
Let the administration bitch about not “negotiating”. When the documents/videos are demanded, the negotiating is over.
