Supreme Court Justice Ketanji Brown Jackson says it’s ‘cruel and unusual’ to criminalize homelessness

“We’re talking about sleeping … that is a basic function,” said the nation’s first Black female justice.

U.S. Supreme Court Justice Ketanji Brown Jackson argued that it is “cruel and unusual” to punish unhoused individuals for sleeping in public spaces.

“We’re talking about sleeping … that is a basic function,” Justice Jackson said during Monday’s oral arguments in a case that could result in the criminalization of homelessness.

On Monday, the Supreme Court heard more than two hours of arguments in the case of Grants Pass v. Johnson. The justices listened to both sides of the case to determine whether cities across the nation are violating the Eighth Amendment and engaging in “cruel and unusual punishment” by placing restrictions on where unhoused individuals can rest.

While the liberal justices opposed criminalizing members of the unhoused community, the conservative majority considered an argument from attorneys representing Grants Pass, which is that the decision to punish homelessness should be left to local governments, not the justices.

“cities/towns/municipalities need to set aside space where the homeless can park rather than on sidewalks”

They do and they don’t want to stay in those spaces because of the rules against drug and alcohol use. Also, the opportunities to either beg or steal are limited.

Vagrants want vagrant in places where stupid people give them money or where they can steal or find and do drugs.

This is why they should be forcibly housed and medicated in state institutions. The vagrant population would drop over time as being locked up attracts fewer to the lifestyle.

If a drug possession charge got you an automatic 6 months at the funny farm instead of released without charges, there’d be a whole lot less of it.

Yet according to the VA only 2-6% (depending on branch) of all veterans experience homelessness. 80% of vets own homes compared to 60% of non vets.

It’s all about who counts the numbers and what questions they ask and if they verify the answers.

Case in point. The Point In Time survey used to count the homeless will ask the homeless person if they are a vet, but no verification is done. In counts where verification is done the number drops.

Vets go to the head of the line in almost all help programs, yet this magical 13% does not show up, because programs require documentation

See how that works.

That didn’t even work in St Louis area-—Rioters broke down the gates & when a couple—homeowners—came out with their weapons to protect their property-—THEY got arrested

The rules for being in a SHELTER include NON DRUGS or ALCOHOL

Most homeless will NOT ABIDE by those rules.

So what are you doing to help. Are you volunteering in your community to help?

Oh I know. It’s more important to sit on a low class web site and shoot your mouth off.

Says the VA. They keep their own records. The PIT counts are roughly double the VA counts.

The VA know who its vets are. The PIT count verifies nothing and uses models for its final numbers. And has a vested financial interest in bigger numbers.

Who do you think is right.

Also, why are you so angry?

If these cities would just make it LEGAL to camp on public property anywhere within 500 feet of the personal residence or office of ALL Officers of the Court, the homeless problem could be managed?

https://news.va.gov/126913/veteran-homelessness-increased-by-7-4-in-2023/

BTW liar. The wife and I take care of a homeless vet. He is totally disabled on his left side and can NOT collect VA benefits. Has his DD214s and since he served at the time of no conflicts, he is not eligible...same as my wife who is 50% disabled and has her discharge papers. Cant collect..not even medicines.

Sick and tired of liars like you spouting off on the internet and wont do shit to even volunteer and go out and reach out to these people.

The VA is the same ol failed slop bucket it has always been.

AS for the rest. Anyone who makes it a crime because of some peoples misfortunes need a bat right cross the head.

Something the states gladly did because they were expensive, attracted law suits so even more expensive for the state to run and prone to scandal.

You realize that VA webpage is using the same suspect Point In Time survey I’ve already discussed and it has nothing to do with your personal situation which is caused by VA rules and not by homeless non vets lying about being vets.

Why would the VA use two sets of statistics? Because they use one set to ask for increased funding and the other set to demonstrate effectiveness. Bureaucratic smoke and mirrors.

I’m very sorry for your personal situation.

I should also add that homeless not vets lying about vets are attempting to suck up resources intended for vets.

Agencies and advocacy groups constantly fiddling numbers like they’re climate scientists does nobody any good. They are just grifting the government dollars into top dollar paychecks while their programs do zilch.

It is awful.

We both know that I have nothing new or novel to solve the problems.

At some point, the 3D printed homes will come en masse and solve a lot of the nation’s housing woes.

I’m sorry to read of your travails. Obv charity is a component of any solution. I applaud you for taking the bull by the horns and wish you nothing but the best.

“We’re talking about sleeping … that is a basic function,”

You stupid moron, we're talking about people addicted to drugs so badly they can't even make a living or pay any rent to stay off the streets. These 24/7 drug fiends are destroying our cities, and you're dumb enough to think it's only about sleeping.

Resign dumbshit, you're not fit for any court.

Finland.
They are the only country in the western world to have the homeless problem drop.

For one reason. Until recently, Finland hasn’t spent its funds on endless wars, controls immigration and understand the reasons behind the problem.
