Philly DA withdraws arrest warrant for Democratic lawmaker

Philadelphia Democratic state Rep. Kevin Boyle is no longer facing imminent arrest by Philadelphia Police Department after new information has come forward to indicate the protection from abuse order that was the basis of an arrest warrant was no longer in effect.

At a late Monday afternoon news conference, Philadelphia District Attorney Larry Krasner said new information learned on Monday filled in a gap and made it clear the that there was no probable cause to justify a warrant for the seven-term incumbent’s arrest.

“Mr. Boyle committed no crime,” Krasner said. “That is a matter to be determined later.”

He said in a domestic violence situation, it is possible more than one possible offense occurred and that is what will be evaluated but that it was inappropriate to comment further at this time.

Krasner did not disclose the new information and said he has not spoken with Boyle, who faces a primary election Tuesday.

He also said he has no reason to think the Philadelphia police acted in bad faith in issuing the warrant based on the information they had at the time. But he said there are some lessons to be learned from this situation.

“There are based on the findings that we have now some work to do behind the scenes to learned from this issue and to try to figure out how wwe can make it better moving forward,” said Philadelphia Police Commissioner Kevin Bethel. “Ultimately, the goal is that Mr. Boyle is not being arrested and the order is being vacated.”

A warrant was issued for his arrest on April 16 for violating a protection from abuse order. Krasner said the warrant was issued based on information he had at the time.

“None of it was fake. None of it was forged. But there was a piece that was missing,” he said. “I will say that I did not want to let this day go by having been able to confirm this morning that the protection order was no longer in effect as of the date in question.”

In 2021, Boyle was arrested on charges of harassment and violating a protection from abuse order. At that time, he was stripped of his committee chairmanship and given limited access to the state Capitol. Following that incident, former Gov. Tom Wolf called on him to resign and get treatment for his mental illness.

Boyle ran for re-election in 2022 and bested opponents in both the primary and general election to win another two-year term. In February, a well-publicized video of an outburst by Boyle at a Montgomery County bar where he acted in an aggressive and threatening manner toward its employees led to him once again being stripped by House Democratic leaders of his committee chairmanship and losing his Capitol access privileges.

After an unrelated news conference earlier on Monday, Gov. Josh Shapiro expressed his hope that Boyle “get help and I hope for his sake that he is safe wherever he is and won’t cause any harm to himself or anyone else. I think that that should be top of mind for everyone.”

Boyle’s brother, U.S. Rep. Brendan Boyle, D-Pa., said last week in a statement “Kevin’s mental illness has been a nightmare for our family.” He went on, “Like any family who has a beloved member with a serious health issue, we are doing the best we can to help him get better.”

House Majority Leader Matt Bradford, D-Montgomery County, announced last week plans to introduce a resolution establishing a process that could lead to Boyle’s expulsion following an incapacity inquiry.

House Republicans, meanwhile, argue that Boyle should be placed on leave immediately instead of allowing him to vote by designating another caucus member to cast votes for him in his absence. Democrats say only Boyle can determine if his remote voting rights should be rescinded to avoid interfering with the will of voters who elected him to his seat.

If Boyle would go on leave or resign from the House, it would create a politically challenging situation for the House Democrats who hold a 102-100 seat majority in the chamber, with one vacancy to be filled on Tuesday in a GOP-leaning district. To pass legislation in the House requires 102 votes.

Yeah - because you KNOW if there had been an R after his name not only would he already be locked up but they’d be pulling him off the ballots before trial.

Whatever it takes to maintain control of the PA House majority will be done by House Democrats and their allies like Philly DA Krasner. No part of the justice system is secure from their corruption. This is standard operating procedure in Pennsylvania, always has been.
