I don’t understand your question; or perhaps the statement you are trying to make that something can’t be a crime if it’s not caught on camera. Felonies take place every day that are not caught on camera. Still a crime, investigations proceed seeking a suspect.

Theft is the most frequently occurring crime in Japanese society, with approximately 330.6 theft offenses recognized by the police per 100,000 inhabitants in 2020
=25% of the rate in the USA.
We do see this in Japan roughly 1/4th as much as in the USA per capita but hey they prosecute.

"And govern Florida he has!" I credit Governor DeSantis with probably saving my life and that of my fragile 86-year-old mother during COVID. He made antibody treatments readily available throughout the state, and she and I both got those treatments on Sunday afternoons within a couple of hours of testing positive for Delta.
I was sick for three days, and she was sick for only one.
I took a few other measures as well, but I won't mention "horse paste" this time around.

Maybe just a technicality, but with the price of things these days, the likelihood of a package being worth less than $40 is pretty small.

It’s up to citizens to do their part in fighting crime. Either have someone at home to take deliveries, pick up the packages at the post office or carrier service points or invest in a cam. They’re not that expensive.

Not making it all a felony doesn’t mean a thief won’t be held accountable. Under $40 just means it’s a misdemeanor, not a free pass.

The $ amount is stupid. In California, you can steal “up to $950” without incident. Who is sitting at the door checking the amount being stolen?
“Hey fella, you’re $13 over the legal theft limit…”
In a just world, there would be bounties for those who commit crime.
