Donald Trump Reveals Abortion Position, Says States Should Decide

Former President Donald Trump officially announced his position on abortion on Monday, ending months-long speculation about how he would handle the issue should he be elected in November.

In a video posted to Truth Social, Trump said the issue of abortion is about “the will of the people” and should be left up to states to decide. The 45th president touted his role in nominating the Supreme Court justices who ultimately overturned Roe v. Wade in their Dobbs decision — ending 50 years of an invented constitutional right to abortion and sending the issue back to individual states and their elected representatives.

So he will NOT sign any legislation that would usurp states rights to determine abortion and other reproductive rights, correct?

Sorry but this is not likely to placate most and will not remove the abortion question as a political factor. Either you acquiesce to the intentional killing of pre born human life or you find the mass killing of the pre born abhorent and destructive to the individual and the culture. No other decision by the Supreme Court or any American political body did more to shatter the once held consensus of decently held common values that had unified America than Roe v Wade.

Others have already raised the 13th Amendment. There seems to be this notion out there that it’s the job of the federal government to fix supposed excesses of the states. Not only is that contrary to federalism, but how do we think the feds are doing on their efforts to rule the whole country by fiat through the administrative state?

I’ve been appalled by the people calling for a national ban. Dodds was decided on precisely the ground that it’s not a national issue, and many in the right didn’t even wait until the ink was dry to start arguing that it is a national issue.

Right!! SCOTUS made a sound constitutional decision to which Trump concurs and Biden doesn’t. Have we ever had a President who flagrantly disregards Constitutional decisions as does Biden??? and no one calls him on it!

Nothing about the right to life has ever been brought before the USSC in a way that forces the issue and requires a decision about when life becomes protectable.
Should it ever happen I hope it does while a conservative majority sits in judgement.

That was the whole point of taking down Roe - that the decision should be made by States and not by judges.

If Republicans want to take this issue off the table they should ballot this issue in every state.

Referendum:

Should all abortion be banned in ____________ (fill in name of state)

Should abortion be banned after 6 weeks

After 12 weeks

After 16 weeks

After 20 weeks

etc etc etc..

Should abortion be outlawed under all circumstances Y or N

Should abortion be outlawed with these exceptions:

rape
death of mother
etc

Each state did decide about the legality of slavery until the passage of the 13th Amendment. (I have to wonder how an Amendment guaranteeing a right to abortion would be worded).

As to marriages and divorces, the Constitution require that each state recognize the official actions of another state. So if you’re legally married in one state, you are legally married in another state, even if your marriage wouldn’t be legal under your state’s laws. This is why people were upset that some states were toying with the idea of legalizing gay marriage, before SCOTUS in its infinite wisdom took that decision away from elected legislators.

Divorce used to be difficult to nearly impossible to obtain in some states, especially New York. But Nevada only required a few weeks residency for someone to file for divorce. Movies in the 40s and 50s would make reference to this by “she moved to Reno”. Get the divorce under Nevada law and you are divorced in NY.

Regardless, it is a civil right. You can’t just walk up to a person to say “Your mother doesn’t want you” and kill them. Slavery was an obvious moral wrong before it was outlawed. We merely justified it by claiming slaves weren’t fully human.
This is less of a legal issue and more of a moral one.

If you have the right to life in Louisiana, you should also have it in New York. If you are not a slave in NY, you should not be a slave in Louisiana. You should lose your rights because you traveled across state lines.

Well, yes — that’s exactly how it works. Very few people can be charged with murder under the Federal criminal code.

That’s a fine argument, except the word BORN is clearly stated in the 14th Amendment. This is why I suspect a “national abortion ban” could potentially be overturned in a 9-0 ruling under the current U.S. Supreme Court.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

I believe created means at the moment of conception personhood is established.

That being said, I believe two things need to happen. SCOTUS needs to rule on when someone becomes a citizen and has rights, Secondly, grass roots in each state need to work on changing hearts, minds and laws in each individual state to prohibit abortion.
