Jack Smith’s Case Against Trump Appears to Be Falling Apart

Special Counsel Jack Smith's efforts to imprison Donald Trump for mishandling classified documents have hit a few snags recently, and the latest snag is, indeed, a big one.

“ Special Counsel Jack Smith could be blocked from using evidence against Donald Trump contained in grand jury investigation files, which were transferred to the former president's Florida classified documents case this week, a former prosecutor has suggested," reports Newsweek.

"In 2023, a grand jury in Washington, D.C., heard evidence from witnesses—including Trump's attorney, Evan Corcoran—while considering whether charges should be brought against the former president and others for hoarding classified documents. However, Trump and his co-accused were later indicted in Florida and, under federal rules, the grand jury files were transferred on Monday to Trump-appointed judge, Aileen Cannon's court."

According to former prosecutor Bill Shipley, the transfer of the case from D.C. to Florida gives Judge Cannon control over what evidence can be included—especially testimony that may have violated attorney-client privilege.

Leftists have been routinely triggered by Judge Cannon’s rulings—probably because she’s not a rabid leftist like Judge Engoron, who literally ruled that Trump should pay a civil fine of nearly half a billion dollars for a non-crime with no victim.

Jack Smith’s prosecution of Trump has been widely criticized as selective prosecution, especially in light of the release of the Hur report last month, which found that Biden “willfully retained and disclosed classified materials after his vice presidency when he was a private citizen,” and that his actions “present[ed] serious risks to national security.”

Despite Biden’s actions, former special counsel Robert Hur declined to prosecute Biden because he would present himself as an “elderly man with a poor memory” and it would be difficult to convince a jury he was guilty of a serious felony because to commit such a crime “requires a mental state of willfulness.”

These cases were obviously brought to effect the election regardless of whether or not Trump was even running - otherwise they would not have waited for the trials to be timed during election season...waiting years after the fact to file them.

Doesn’t matter if they have merit - “he’s under criminal indictment” - “he’s under investigation” is the ongoing narrative. And while this selective prosecution will solidify his support, it also lowers the ceiling of support as some people in the middle won’t even consider him due to this.

Democrat scandals are also reported, if at all, as Republican scandals: “How did the Republicans get this information?” is the story, “attacking President Biden’s family”, etc. “This is 60 Minutes! We can’t report on something we can’t substaniate!”

They’re blaming the judge?! So next he’ll come out and say it was unfortunate, we had a great case, but we can’t let classified info into the public, so we had to abandon it?

This case is insane. The President has ultimate authority of classification. Every document that has been placed before the court can be labeled UNCLASSIFIED by the word of President Trump. EVERY SINGLE DOCUMENT that was in his possession could be declassified at his word of mouth. There isn’t a person on earth that has the authority that he held. All of these other persons who held classified documents had zero authority to be in possession of them. Yet, none of those persons were prosecuted! These people are evil. Who packed all of these “classified” documents? We 100% know that President Trump did not pack the boxes. This is a setup by scum sucking pig government hacks. You cannot transfer classified documents willy nilly by stuffing it in a box and moving it in an unsecured manner. Washington DC is a dark place.

I've been beating this very same drum for months {if not years}.

The difference between a Senator or VP having classified docs in an insecure location is that they are still CLASSIFIED, while any President has the power of de-classification by merely thinking about it {no word of mouth or written document is required by law}.

This jack smith debacle is pure harassment and Trump cannot loose the case.

Smith’s own background is full of dirty deeds. I did a little research on him- I wonder how he sleeps at night. He’s a very compromised individual with no moral backbone

How can a former President even violate the Espionage Act for possessing National Defense Information ?????? Ex Presidents retain authorization to view such documents (with a need to know) and routinely took such documents with them when they left office. Not one of them was prosecuted under the Espionage Act since it was passed in 1917 except for Trump.

Yes, the DS put in a new functionary at Archives who definitely set Trump up … packaging and delivering papers to Florida only to quickly claim his criminality in a way no President was ever before charged.

The FBI the ran with Archivist’s gunned-up complaint and here we are …
