The relevant part of the article is not clear. But I think shadowlands1960 is correct. Because the guy was charged with just a misdemeanor, the prosecutor evidently cannot ask for bail to hold him.

From NYC news media... apparently if you’re charged with a misdemeanor they can’t hold you on bail... even for assault.
