Crime of passion - love,
Crime of passion - hate.
In both cases, the criminal charge is for the physical act that causes harm, not for what you were thinking and, or, feeling - the passion in you - when you took physical action that caused harm.
Yet, the political left (and unfortunately some on the right) wish to tack on a criminal charge of passion, for example:

That criminal charge is a violation of the First Amendment. For the same reason that the following criminal charge of passion is a violation of the First Amendment:
Criminal Charge for Love
If you bypass or dismiss the protection of the First Amendment, you allow the state to charge you for the crime of loving your neighbor and following Jesus.
