US Supreme Court Lets Texas Enforce Law on Illegal Border Crossings

The U.S. Supreme Court on Tuesday declined to block a Republican-backed Texas law allowing state law enforcement authorities to arrest people suspected of crossing the U.S.-Mexico border illegally, rejecting a request by President Joe Biden's administration.

The administration had asked the justices to freeze a judicial order allowing the Texas law to take effect while the U.S. government's challenge to the statute proceeds in the lower courts. The administration has argued that the law violates the U.S. Constitution and federal law by interfering with the U.S. government's power to regulate immigration.

Texas Governor Greg Abbott last December signed the law, known as SB 4, authorizing state law enforcement to arrest people suspected of entering the United States illegally, giving local officers powers long delegated to the U.S. government.

Confusing. Didn’t SCOTUS just say Texas couldn’t meddle with immigration matters? I like this ruling much better, but....

What Texas’ SB4 immigration law does:

SB4 empowers Texas law enforcement officials, at the state and local levels, to stop, jail and prosecute migrants on illegal entry and reentry charges.

It also allows Texas judges to order migrants to return to Mexico as an alternative to continuing their prosecution, effectively creating a de facto state deportation system.

The Justice Department has said SB4 conflicts with federal law and the Constitution, noting that immigration enforcement, including arrests and deportations, have long been a federal responsibility. It has also argued the measure harms relations with the Mexican government, which has denounced SB4 as “anti-immigrant” and vowed to reject migrants returned by the state of Texas.

Abbott, who has positioned himself as the leading state critic of President Biden’s border policies, has portrayed SB4 as a necessary measure to discourage migrants from crossing the Rio Grande, arguing the federal government has not done enough to deter illegal immigration.

Over the past three years, Texas has mounted the most aggressive state effort yet to challenge the federal government’s power over immigration policy, busing tens of thousands of migrants to major, Democratic-led cities, assembling razor wire and buoys along stretches of the border to deter migrant crossings and filing multiple lawsuits against federal immigration programs.

How exactly was the Scotus going to STOP TX Leo from doing this?

We are rapidly getting to the point where nobody is really paying attention to the SCOTUS. (biden and student loans).

What is the SCOTUS mechanism to enforce these types of ruling against a state, or a president?

Great news, but does this mean that if Trump survives the attempted election steal in November, that if Trump rebuilds the wall, that California (or AZ or NM) can tell him to take a hike?

California could REFUSE to to arrest Illegals, however all Federal authorities would obey Trump and arrest 'em all, where ever they were.

Even the ones hidden in the Governor's Mansion, and they would have a lot of fun searching it.

Every Citizen of Texas should be able to withhold that amount from their Federal Taxes that was for the Dept of Homeland Security, since Traitor Joe and his Butt-Boy Mayorkas have seen fit NOT to enforce the duly enacted laws for border security.

THAT is now being done by Texas!

I think they previously just continued the injunction that they had put in place (or something along those lines) and then today issued an actual order.

Texas has expended 11 billion state funds to enforce the border that this administration has plied open. I support what Texas is doing. No doubt the sanctuary jurisdictions who encouraged this mess and are now suffering from it will be primary beneficiaries of Texas’ actions, But I doubt they will be sending Abbott a Hallmark card and a check thanking him. What Abbott can’t push back across the border, he can ship north to Massachusetts to choke on their virtue signaling and where they have more geography to accommodate them than urban NY, Chicago and Denver

So, does this mean the feds can still allow illegals in through an office crossing, then process and release them into Texas?
