Cannon, who was appointed to her post by Trump, ruled that question “warrants serious consideration” but should not be decided at this point.

That’s not dismissing, is it? She just says, “at this point.”

Yes.

Judges often look for the latest possible "off ramp" before making a controversial decision. They don't want to be too premature in making a ruling when there are still other things that can happen before the ruling becomes the last resort.

An exception would be when the motion is so clear-cut and decisive that the ruling makes sense at that moment, such as a tainted warrant or falsified evidence or obvious prosecutorial misconduct or witness/jury tampering where a mistrial is called for.
