To keep her campaign promise to “get Trump,” DA James turned Consumer Protection law upside down. The law is intended to protect consumers w/ no way to help themselves from predatory lenders, so they turn for help to l/e.
In this topsy turvy case, Trump is labeled the predator, accused of “preying on lenders”....
very sophisticated lenders who are fully capable of protecting themselves.
Lenders who had no gripes, no losses, who hadn’t asked the attorney general for help.
Appeals Judges are going to have to look carefully at what the powers of a NY attorney general are here.
Are they so broad that James can arbitrarily invert the law to keep a campaign promise to “get Trump?”
Is she empowered to look at a financial statement, then decide what is a “lie” (that nobody believes).
Is she empowered to put someone out of business when no fraud occurred?
Can she confiscate property for no reason whatsoever?
Astute businessman, Shark Tank’s O’Leary, summarized that what Trump was being raked over the coals for is everyday good business practice, “done by every real estate developer everywhere on earth in every city, and has never, ever been prosecuted.”
Welcome to Leftistism. What these evil morons never seem to understand, is that eventually, they take so much from so many people, that they end up hanging from a rope. Or course, that generally only happens after society has been mostly broken down/destroyed. Their narcissism, greed, and envy (along with their ignorance) blinds them to this reality.
What about property taxes??
If the state “overvalues” a property. And Charges X tax based on that valuation.
If some judge with no real estate experience decides that the property is not worth X. Do they get to sue the state and get back their taxes?
