The article says that “Donald Trump is being prosecuted for the same exact crime.” But it is not possible to charge Trump for the same exact crime because, as President, Trump had an absolute right to take any of those materials, while Biden, as a senator or Vice President did not have any right to take them. So Trump’s “crime” would necessarily have to be something more creative.

Even the people who can grant permission to access classified documents must get their authority from the President. But the President doesn’t need their permission.
