If he was cogent then, then he’s guilty.

That is true, as far as whether or not he is actually guilty, but it is not true when determining whether or not to prosecute. He has to be able to assist in his own defense, and his ability to do that is questionable. That's why invoking the 25th Amendment has been put on the table, even by some Democrats.

It's interesting, though, that he acknowledges that he is old, but he asserts that his memory is fine. So he can't now present himself to a jury the way Hur hypothesized he would. In my book, that puts prosecution back on the table.

There is still, however, the fact that the DOJ has a policy against prosecuting sitting presidents. So the earliest this could happen would be the afternoon of 1/20/2025.

lol I doubt he was cogent even then, that man is dumb as a box of rocks and that is quite a slur against boxes of rocks

What I find fascinating is the “bad memory”… argument is exactly what 25th was meant for.

Looks like the plan is matching forward
