Judge Aileen Cannon, a Trump appointee, shut down Special Counsel Jack Smith’s attempt to keep names of government witnesses and other discovery under seal in the classified documents case against Trump.
Jack Smith last June indicted Trump on 37 federal counts in Miami.
Trump was charged with 31 counts of willful retention of national defense information and 6 other process crimes stemming from his conversations with his lawyer.
Jack Smith has been fighting to keep the names of government witnesses a secret. He also opposed the unsealing of discovery material because one document confirms the existence of another FBI investigation.
Last month President Trump’s lawyers filed a motion asking Judge Cannon to compel Jack Smith to turn over documents.
The documents produced by the special counsel’s office were heavily redacted.
A press coalition included The Associated Press, The New York Times, The Washington Post, CNN, Fox News, and other outlets have also requested the unsealing of the discovery material.
Jack Smith opposed Trump’s motion to disclose discovery material in a 4-page filing reviewed by The Gateway Pundit.
The special counsel argued the discovery material must be kept under seal because one document confirms the existence of another FBI investigation…presumably into Trump.
It is unclear which FBI investigation Jack Smith referenced, however it has been publicly reported that the FBI opened an investigation into Trump’s ‘possible involvement in January 6’ in April 2022.
Jack Smith requested certain documents to remain sealed in full.
Judge Cannon on Tuesday denied Jack Smith’s request to keep some of the discovery under seal.

The federal judge overseeing the classified documents case against former President Donald Trump put a damper on Special Counsel Jack Smith’s victory in his separate case in Washington D.C.
The D.C. Circuit Court of Appeals on Tuesday shot down Trump’s bid to dismiss his federal election interference case based on presidential immunity. On the same day, District Court Judge Aileen Cannon, who is overseeing the other case against Trump in Florida, ruled that some discovery material that Smith wanted to keep under seal would be disclosed, reminding him “of the strong presumption of public access in criminal proceedings.”
“Following an independent review of the Motion and the full record, the Court determines, with limited exceptions as detailed below, that the Special Counsel has not set forth a sufficient factual or legal basis warranting deviation from the strong presumption in favor of public access to the records at issue,” Cannon, a Trump appointee, wrote.
Smith sought to keep under seal information that reveals the identity or personal identifying potential witnesses or could lead to “witness safety and intimidation” concerns.
“Although substantiated witness safety and intimidation concerns can form a valid basis for overriding the strong presumption in favor of public access, the Special Counsel’s sparse and undifferentiated Response fails to provide the Court with the necessary factual basis to justify sealing,” she wrote.

If these documents are so deeply secret, I don’t know how a mere lawyer like Jack Smith has sufficient clearance to even handle the folder, let alone review the contents.

People forget providence is not exclusive to the realm of God’s people.
It stuns me how so many supposed educated elite continue to use the most simplistic thinking about God and people who believe in him.
Personally I do think God is working through Trump, for that matter Biden too, just at this time, Trump’s actions and experiences are an active part of God’s will.

Surprise, surprise! I always thought that an accused man had the right to know who his accusers were. Correct me if I’m wrong.

Isn’t it the right of the accused to know who is making the accusation. Further isn’t it necessary for the defense to know so they can investigate them to see if they have another motive?
And last, don’t we as Americans have the right to know who is trying interfere with our elections?

Unfortunately while Fani may get fired (probably) and dis-barred (hopefully) the case does not go away. It will be reassigned to another judge or district, hopefully not to another leftist appointee. Some legal beagle can correct me but I believe that unless a sentence has been issued double-jeopardy is not in play.
