Taking away Trump’s business empire would stand alone under New York fraud law

NEW YORK -- Within days, Donald Trump could potentially have his sprawling real estate business empire ordered “dissolved” for repeated misrepresentations on financial statements to lenders, adding him to a short list of scam marketers, con artists and others who have been hit with the ultimate punishment for violating New York’s powerful anti-fraud law.

An Associated Press analysis of nearly 70 years of civil cases under the law showed that such a penalty has only been imposed a dozen previous times, and Trump’s case stands apart in a significant way: It’s the only big business found that was threatened with a shutdown without a showing of obvious victims and major losses.

Here’s another ugly truth: Government is basically a parasitical entity that consumes the wealth of others by coercion. All of that becomes magnified when government is taken over by the parasitic class of humans who wish to use the state’s power to enrich themselves of others’ wealth. This is the primary reason government at every level should be as small as possible. We as a nation are paying a high price for not paying close enough attention the the growing malignancy that now threatens our very existence.

It is more likely that President Trump will win and the judges and persecutors will be the big losers.


I don’t see how that happens in NY state. Nearly the whole political apparatus has gone to war with Trump. It comes down to: Orange Man bad so lets destroy Orange Man.

I am sure other rich people are taking notice and NY will eventually pay the price. Like CA, it will be reduced to a small number of hardcore leftists ruling over lots of poor people.

If I were Trump I would fill the bottom two stories of my high rise buildings with manure and concrete. I would then go on a campaign to encourage the exit of capital from the city. Leave the city a vacant slum, housing only the UN and government buildings. The government sloths all work from home anyways.

I think he’s pointing out more of the big guys like Trump need to make sure they are properly representing their business books. Little guys couldn’t fight back and took the legal hits. Big guys could fight back. This now makes them vulnerable.

What are rules and guardrails if they aren’t enforced? Society needs structure. Thus rules and guardrails. The wealthy hates structure because it makes them play by the same rules we must. They hate being us.

Real estate and banking interests are very powerful behind the scenes players in New York City politics. This farce is being pushed by the state AG who seems to think she has all the power and influence.

It’s not big businesses that should worry. Anyone who listed a house for more than it sold is guilty of fraudulently inflating the value of an asset.

I’m sure divorce settlements are littered with one party fraudulently inflating the value of assets to pry more money from the other party.

Car dealerships, pawn shops, flea markets, EBay, etc.

This is a lie.


Not only a lie, but a demonstration of total ignorance of how things really work when you borrow.

First, you can think whatever you want about the value of your property but the bank will send an auditor to your property and you are at his mercy.

For instance several years ago I was considering borrowing and I really did not need to, my credit report was in the highest bracket. Yet several banks and insurance companies turned down the opportunity. The reason: I never borrow... I pay cash.

I owed nothing other than normal household monthly bills,,,all paid on time. House, land, equipment all paid for.

The point being that the lender is in the driver’s seat. He determines whether you get the money. Unless you rob him, you can not force him.

When I as in business, I eagerly sought out people who paid cash promptly and according to agreed terms.

Even deflating on a loan is not grounds for prosecution

What you can be prosecuted for is hiding financial obligations from the auditor. A potential borrower is obligated to give the loan company truthful information.

I read just lat week where BlackRock has intentionally defaulted on loan payments on a huge skyscraper on the West Coast....I think some 300 million. Are they going to be accused of a crime?

Have we sunk so low that we accuse a man of fraud who has paid everyone according to the terms and who has by that made the deal profitable for all involved?
