People who make this statement don't have a clear understanding of the situation then and now. When Andrew Jackson made his statement, he was President. Only he could order the military or any branch of the Federal government to actually implement the decision of SCOTUS. Since the case in question was one that was decided AGAINST Jackson, there was no way he would enforce that decision and no way for SCOTUS to force him to do so.
