EXACTLY! I keep bringing this up - that it is both unconstitutional and plainly immoral to penalize someone for a crime they have never been convicted of.

In fact, he was acquitted of the charge of insurrection by the Senate in his second impeachment trial.

Better question: When was an insurrection declared in the first place?

The “Insurrection Act” gives the president the power to declare an insurrection. Article I, Section 8, Clause 15 of the Constitution says Congress can provide for the militia to suppress an insurrection.

And that’s about it. But the Democrats feel otherwise. They seem to think anyone anywhere can declare that an insurrection has taken place.

Never but apparently we now have a justice system worse than North Koreas. At least in North Korea they “convict” someone THEN issue the punishment. Here, they now punish someone before being convicted.

Even if there was proof positive offered that Trump participated in an insurrection the amendment does not apply to ex presidents. That is the plain language which so many miss.

In the end the biggest losers will be Biden and all of those Republicans participating in this Biden manipulated primary instead of getting behind the victim of this election interference. If they really were against government control they would be saying “We are all Trump!”
