The guy was flat on the ground already, so I think the main issue is that the cop could have just disengaged by standing up and backing off: which he wound up doing anyway as he shot him.
So the legal question is whether the cop has justifiable fear for his life. Maybe at the first or second shot, but not afterwards.
A taser/pepper spray etc can debilitate or impair a person at least temporarily, at which point the suspect can seize the cops gun. Can't let that happen.
Btw, reaching for the cops gun is not the issue due to the fact when the shooting happened the suspect was on the ground and the cop was standing when it appears he shot the suspect 3 times. Not including the round that missed and hit the freeway.
In other words, at the time of the actual shooting, the suspect had no way of reaching the cops gun even if he tired. The suspect was shot because he either pointed a taser at the cop or tried to reach for taser.
That video was heavily clipped and edited as to favor the attacker.
It’s been verified that both the cop and his attacker were on the ground fighting for the gun. Yet we don’t see that part.
The cop was able to get off the ground first. Thankfully he was smart enough not to wait till the attacker got up and resumed the fight.
In simple terms, don’t believe that video.
