Trump has not been found guilty of that crime.
I agree with you but virtually no Confederate officer or government official was found guilty of any crime, yet they did lose the right to hold public office until reinstated by act of Congress. All they need do is convince a judge that Trump’s actions/inactions constituted an ‘insurrection’.
