Abbott is just doing his job to protect Texas since Biden won’t. Station the Texas Nat’l. Guard next to each barrier and keep the illegals out. They are breaking Fed and Texas law by crossing into the USA. Biden and Mayorkas should be arrested and imprisoned for not protecting Americans.

It's time to get rid of all these bureaucratic boards and commissions, usually composed of purely political appointees. Hunter Biden, for example.

I have one question to ask these dumbass Federal prosecutors. Why in the hell do the foreign invaders, supposedly seeking asylum as you idiot claim, have to risk their lives ILLEGALLY wading across the Rio Grande River? Why aren’t you jugheads going over and escorting them to the safety of the asylum? Would that be aiding and abetting or something?

Abbott should refuse to remove the barriers and send DPS troopers to guard them with orders to shoot anyone who interferes.

Baloney. If the Federal government is not protecting the Texas Mexican border from illegal border crossers or illegal commerce then they have abrogated their duty and by default have opened the door for Texas to defend its border. Abbott should declare that Texas is being invaded by a foreign power. If the Federal government fails to stop the invasion Texas has the right to secede from the union.

As a political matter I agree with you we need to defend the border. As a legal matter Abbott doesn’t have an argument.

Indeed. If the Federal government cannot or will not stop illegal border crossers, why would he think they could defy the decisions of the rightfully elected governor of Texas.

I disagree. Where in the Constitution is a state prohibited from erecting a barrier on its territory? The only argument I could think of would be using such a barrier along a border with a neighboring state, which would restrict interstate commerce.

The text quoted in #27 appears to say Texas does have the authority as recognized in the constitution. Since they are clearly being invaded.

The river, as a navigable waterway, isn't Texas' territory. The Constitution also empowers the creation of treaties, which have supremacy over state laws, and Texas' actions impede lawful treaties in effect.

The Supreme Court will decide this one and the State of Texas and the federal government will comply with the decision.

The bottom line is:

Texas State Troopers are not going to shoot Coast Guard or Corps of Engineers members while they are removing the barriers.

Federal agents are not going to shoot State of Texas employees or their contractors while they are deploying the barriers.

And also Article IV Section 4:

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
Ordering the removal of defensive buoys against invading migrants is the opposite of their constitutional requirement to "protect" the states against invasion.
