Texas ordered to remove Rio Grande floating barrier, Gov. Greg Abbott promises to appeal
The New York Post ^ | 09/06/2023 | MaryAnn Martinez

Texas must remove the floating barrier buoys the state placed in the Rio Grande River to deter illegal immigrant crossings, a federal judge ruled Wednesday — but Gov. Greg Abbott wasted no time in announcing he’d appeal.

District Court Judge David Ezra ordered the wrecking ball-sized buoys be taken away by next Friday and banned the Lone Star State from adding any other structures in the Rio Grande — the international boundary between the US and Mexico in Texas — without prior approval from the feds.

Soon after Ezra’s ruling Abbott released a statement, vowing that “Texas will appeal.”

“This ruling is incorrect and will be overturned on appeal. We will continue to utilize every strategy to secure the border, including deploying Texas National Guard soldiers and Department of Public Safety troopers and installing strategic barriers,” the governor said.

Removal of the 1,000-foot marine barrier is part of a preliminary injunction, not a final ruling in the federal lawsuit. *** In July, the Justice Department sued Abbott, arguing he did not have the authority to order the placement of the river buoys.

The Republican governor never sought necessary permission from the International Boundary and Water Commission to install the barrier, the federal agency in charge of the river told The Post in July.

Federal prosecutors argue the string of large, orange buoys — meant to prevent asylum-seeking immigrants from venturing into the waters of the Rio Grande near Eagle Pass, Texas — are also a “threat to human life.***

Abbott should declare that Texas is a sanctuary state- a sanctuary from rules, orders, and laws that are designed to destroy the sovereignty of Texas.

Let The Big Guy order the National Guard to remove them. Let the world see just how much contempt he has for our borders...our nation.

Perhaps a busload of “migrants” can be sent up to this judge’s home.

Texas will lose in court over this nonsense. It is illegal and unconstitutional. They can appeal all the way to the USSC, Texas will lose.

I had a obama.gov job hauling hot mix out of Minot North Dakota to the various border stations on the canada/ US border.
They were building new stations there and we were black topping the new road.
Twas kinda funny because illegals were working to build the new stations that are supposed to keep the illegals out

How does a judge in Hawaii get assigned to case involving the border between Texas and Mexico? Was everybody else on vacation?

“...are also a “threat to human life.***”

The river, is not, of course, a threat to human life.

Wonder how many lives have been saved by discouraging crossings?

And why would Abbott feel the need to obey a ruling? The illegals are free to break the law without consequence and they get money from us taxpayers for doing so. Biden feels free to break the law. He should not remove the barriers and proclaim he has learned from Biden.

“It is illegal and unconstitutional.”

You don’t know what the hell you are talking about.

The Constutition gives states the authority to stop an invasion of their borders.
