Store clerks have legal options when someone shoplifts. Teaming up to brutally beat the thief isn’t one of them. No wonder two 7-11 clerks in Stockton who battered a would-be shoplifter with a wooden rod are being investigated by police, as reported on TV news. Although brazen stealing is frustrating, costly and dangerous to store employees, confronting it with violence that far exceeds self-defense is not the answer.

Well, Stealing is illegal, beating is illegal, what difference does it make, we are not enforcing rules these days.
According to police, an employee at the 7-Eleven on Center Street, across the street from the Stockton Police Department headquarters, called officers at 3:41 a.m. on July 28 to report a suspect who went behind the counter and threatened to shoot the victim if he intervened.
According to police, the man got away with several packs of cigarettes and other items that he placed in a large garbage bag before leaving.
Less than 24 hours later, on July 29 at 12:27 a.m., the employee called police again to report that the same suspect entered the store and demanded money while simulating having a handgun.
The employee didn't comply and the suspect grabbed food items and put them in a garbage bag before leaving, police said.
At 3:05 a.m. [on July 29], officers responded to the intersection in front of the store to meet with firefighters who were with a man complaining of pain in his leg and shoulder.

I watched the video. The thief told them he had a gun and kept reaching for his back pocket. By any reasonable standard they were justified in defending themselves up to and including shooting him. Their actions actually showed great restraint.

Would this incident have happened if the Modesto police and DA arrested/prosecuted thieves? The thief believed the police would do nothing. The store owners believed the police would do nothing about the theft. They were both correct. Government abdication of its fundamental duties forces honest citizens to protect themselves. J’accuse The Modesto government, which might as well have beaten the scumbag themselves. All public officials there who support non-enforcement should resign immediately — they are stealing their paychecks.
From what I could see it was a very restrained beating, using light cane, with all blows aimed at the thief’s legs, not his head. What they dished out was a few love taps to correct a rotten child. A solid ash bat shampoo would have been brutal and edge closer to illegality, though I would vote not-guilty.
For some reason they can charge the guys who beat the crap out of a brazen thief but will allow brazen thieves to brazenly steal with no response.
I would say that if store owners DONT dissuade these thieves they’re stupid.
I would argue that we’re WAY beyond worrying about the perps on the street and need to exact extrajudicial punishment of those who abrogated their public service, thereby directly endangered the public.
It could be argued as a public service.

Laws need to be changed, to allow victims to stop thieves by any means necessary. Car, boats, womens honor, childrens innocence, money, jewelry or just piece of mind. Let the owner do as he pleases to those who are in the process of committing a crime.

Jumping on my car? First thing I think when I see someone doing that on the streets is, put in my ear plugs, and put some holes in the roof. In the world of 2023, who can afford full coverage insurance? Every vehicle I own is paid for, when it is destroyed, I HAVE TO WORK TO REPLACE IT. That thing is mine, PERIOD.
If no serious bodily injury was inflicted I would argue that the use of force was not excessive, but I won’t pretend to be objective.
