Somebody named Pollack wrote the article, not Kelly. The article claims she said "Special Counsel Jack Smith very well could ask a D.C. judge to deny Donald Trump’s release, to deny him bail once he is indicted, and arrested, and arraigned."

NOTE: could ask a DC judge...to deny which is different from the title, whoever wrote it.

I would guess that it is unlikely, but not impossible, for a DC judge to grant such a request, if Smith ever makes it, but in that event it could get overturned by a higher court.
