“The potential consequences of a successful conviction in this case are significant, Forgues said. She said that if Anderson were to be convicted, the precedent would mean that every single firearm in Minnesota without a serial number, including those made before 1968, would render their owners instant felons. The ramifications would extend to hunters and countless families who have inherited firearms over generations, along with those who build their own weapons.”
There is an ATF form that one can fill out, I think it’s Form 1.
The Podesta’s, Clinton’s and a host of others were allowed to backdate their FARA paperwork and amend their taxes, why can’t this guy be allowed to do the same with the ATF?
Learn the magic words, "Come back with a warrant" and "I want to speak to a lawyer". Never invite police into your house, never go outside to talk to them. Keep the screen door between you locked at all times.
I know people want to be "good citizens" because "the police are our friends". You are not six anymore. Time to leave fairy tales behind.
Yes, he should just plead “Biden”.
Making your own firearm is an American tradition. Requiring serial numbers is not.
So what was determined about the broken glass door? Was that a false claim by a homeowner unhappy with firearms noise? (Where are the pics of the bullet hole?) Or were young yahoos shooting without making sure their projectiles were being stopped? Extremely bad to fire towards someone’s home.
If the firearms were manufactured in the state, for personal use, with no intent to sell, I’d expect the case to be dismissed at trial or appeal. The prosecutor is just showing how they can ruin a citizen without needing no stinkin’ law on their side.
Why do people speak with law enforcement? If the officer is asking, he can’t. It is not your job to help him make a case against you.
It has no historical background before 1900. It is clearly unconstitutional under the Bruen decision.
This may be a good test case.
“Under the plain meaning of the statute, the rifles made and possessed by Anderson were not ‘firearms’ as contemplated in [the federal law] and thus no serial number was required,” his attorney said in court documents. “Federal law does not require serial numbers to be placed on personally manufactured firearms created for private use.”
Additionally, if state law actually does ban Anderson’s privately made firearms with no serial numbers, then it should be ruled unconstitutional, his attorney argued.
There is no federal law requiring serial numbers on privately made firearms.
If Minnesota enacted such a law, it would be unconstitutional under the Bruen decision and the Second Amendment.
They are fighting this. I expect the prosecution to be dropped, but it takes money to fight the charges. The state law is muddy and references the federal law. No crime committed.
