There are strong arguments to make about selective prosecution and Trump’s ability to take even classified documents as part of the Presidential Records Act. He might even be able to argue that he declassified most of the documents as President before he left office. I think his greatest exposure is the fact that they have him on tape appearing to show a classified document to people without security clearances and admitting that it was still secret and acknowledging that he could have declassified it as president but could not anymore. That appears to prove that he knowingly shared classified data with unauthorized persons. The PRA gives him the right to retain classified documents, but does not give him the right to share them to others that are not authorized to have access. Unless he can provide some evidence that he declassified the document in question before he left office, his arguments about the PRA and selective prosecution will be irrelevant, at least in regard to this charge.

From Paul Sperry at RCI:
Sources say Special Counsel Smith does not actually have the supposed “smoking gun” doc Trump is heard on an audio talking about, which means he cannot prove it is classified and thus prove Trump knew it was classified. Prosecutors have no real evidence to show jurors.
McCarthy joins those on the left that has accepted allegations as evidence. The DOJ and their faithful media mouthpieces know that all they have to do is leak a few juicy bits to those on the left, and the shouts of "guilty--hang him" will begin. It matters not that the allegations and the leaks are all manipulated and designed to have people reach certain conclusions, the pile-on begins immediately. McCarthy has been proven wrong time and time again, but conservatives continue to go to him for informed opinions on the law and Garland's political prosecution of Trump. When will conservatives learn that is it all by design--including the comments by McCarthy?
