Scoop: Fox News says Tucker Carlson breached his contract

Fox News Wednesday notified Tucker Carlson's lawyers that the former prime-time anchor violated his contract with the network when he launched his own Twitter show on Tuesday, according to a copy of a letter obtained by Axios.

Why it matters: A breach of contract claim sets Fox News up to explore potential legal action against Carlson, a move that would intensify the already thorny public battle between the two parties.

Carlson’s lawyers told Axios that any legal action by Fox would violate his First Amendment rights.

“Fox defends its very existence on freedom of speech grounds. Now they want to take Tucker Carlson’s right to speak freely away from him because he took to social media to share his thoughts on current events," said Carlson's lawyer, Bryan Freedman, in a statement to Axios.

My take is that Tucker is under contract to have an opinion show on Fox. They are refusing to allow him back on the air on Fox. But they are still obligated to pay him provided he doesn’t go to work for one of Fox’s competitors. So he just does free non paid non commercial Twitter posts of his private opinions and Fox still has to pay him because he’s just posting on social media and is not in competition with Fox.

Fox has two choices, either put him back on the air and get the benefit of his commercial draw, or let Tucker keep posting and pay him for nothing.

Fox is screwed. They need to give him his time slot back, or they are done as a viable news network.

Good move, Fox News Network. Within less than half a day after it premiered, episode 1 of “Tucker on Twitter” generated FOURTEEN TIMES AS MANY VIEWERS as averagely viewed his nightly show on FNN. Paul Ryan and Rupert Murdoch’s sons have shown their brilliance once again/s.

FOX will have a hard time demonstrating that they've suffered any monetary damages as a result of this breach.

I'll bet they claim the loss of viewers is a form of damages!

Right. But the problem there is that FOX didn’t lose viewers because Carlson did his own Twitter broadcast. They lost viewers because they took Carlson off the air. They can’t sue for damages that they brought upon themselves.

They lost viewers because they took Carlson off the air.

Correct.

They can’t sue for damages that they brought upon themselves.

They just might try. Sue in New York, get a New York jury and a liberal judge and it might just work. Our legal system is that corrupt.

FNC is in NY which is very bad for Tucker if it goes to court. NY, DC and CA the rats control the courts in those places. What terrible place we are in when you 3 of the country’s biggest concentration of power absolutely comprised.

If I were a leftist zealot, I would be using NY, DC, etc. juries and governments every chance I got.

This has been discussed ad nauseam. Tucker contends that Fox breached by its smear campaign that they launched right after his dismissal using documents and video that were exclusively in the control of Fox Employees. These are facts that are irrefutable. However, Tucker goes on to assert that he was placed in this position as part of the settlement with Dominion. If this is established, it places Dominion in the situation of being a partisan actor, and thus not independent or trustworthy as a provider of Election services. This is a bigger game by far.
