The Manhattan District Attorney’s Office has made the decision to charge Daniel Penny, a 24-year-old former Marine, in connection with the incident on a New York City subway train earlier this month involving a deranged homeless man named Jordan Neely. It is expected that Penny will turn himself in on Friday to face criminal charges. Penny was one of three individuals who helped subdue Neely to protect fellow passengers and is seen in video of the incident keeping Neely in a chokehold.
NBC 4 New York is told this decision to charge Daniel Penny was made by the Manhattan District Attorney’s Office – and will happen without being presented to a grand jury at this time.
A Manhattan District Attorney spokesperson and NYPD spokesperson have not returned requests for what charge or charges might be filed Friday. Penny’s attorney did not returns calls for comment.
Penny’s attorneys have said previously there was no way he “could have foreseen” that his bid to subdue an alleged perceived threat would turn deadly.
Neely’s family says that amounts to a confession.

My god. The behavior that people like you will tolerate. He was threatening others. The only problem was, Penny picked the Soviet Union to remove the threat.
Out of sight, out of mind. But seeing the takedown and report of subsequent death on TV, tripped the collective “KA-CHING” glands in the family, and they were suddenly in mourning, demanding their version of “justice”.
DA BRAGG was just acting on this emotional response.
Ok. Then when your life or property is threatened, and I’m in the area, you’re on your own.
Who defunded the police?
What did he do or say? (Enlighten us.)
I haven't seen or heard any eyewitness accounts that presented this. Everybody seems to be pointing at the fact that he was a public nuisance with a rap sheet.
That might be enough to convince a lot of Freepers, but Penny is going to need more than this in a court of law.
I visited NYC nine times and toured most things there over the years. I really liked it, was last there in 2016, and will never be able to go back. Would fear the subway now
Liberals for all their denials hate soldiers.
This Is Turning Into Another George Floyd Situation
Here's a couple.
("Rather than wait for Neely to carry out his threats, three men stepped up.")
Penny's got a problem.
Alex, I'll take how to neutralize a threat, for a thousand.
Let's think about this for a moment. You have the mental case under control, therefore you ease up and relax. The nut case starts it all over again.
You left out mentally I’ll.
The one eyewitness I’ve seen quoted in a media report about the incident described Jordan’s actions as “somewhat aggressive speech.” That doesn’t tell the full story, but it also doesn’t sound particularly ominous.

“Neely, 30, was having a mental episode and threatening straphangers….
That report has no references to any eyewitness accounts on the scene. In fact, it’s not even a report about the actual incident. It’s about a dingbat politician’s response to it.
Maybe Bragg needs to meet some subway thugs.
Please correct what I have wrong:
This guy never actually assaulted, or threatened to assault anyone.
But because he was acting out so weirdly everyone was afraid of him.
So the Marine restrained him. He died accidentally.
That’s my interpretation.
Then a manslaughter charge seems appropriate, at least on the surface.
It’s very possible that his family tried to help him but he refused to get help; in a situation like that, all you can do is walk away.
We had a similar situation in my family.
