DA BRAGG was just acting on this emotional response.

I haven't seen or heard any eyewitness accounts that presented this. Everybody seems to be pointing at the fact that he was a public nuisance with a rap sheet.
That might be enough to convince a lot of Freepers, but Penny is going to need more than this in a court of law.

The one eyewitness I’ve seen quoted in a media report about the incident described Jordan’s actions as “somewhat aggressive speech.” That doesn’t tell the full story, but it also doesn’t sound particularly ominous.

That report has no references to any eyewitness accounts on the scene. In fact, it’s not even a report about the actual incident. It’s about a dingbat politician’s response to it.
Maybe Bragg needs to meet some subway thugs.
Please correct what I have wrong:
This guy never actually assaulted, or threatened to assault anyone.
But because he was acting out so weirdly everyone was afraid of him.
So the Marine restrained him. He died accidentally.
That’s my interpretation.
Then a manslaughter charge seems appropriate, at least on the surface.
It’s very possible that his family tried to help him but he refused to get help; in a situation like that, all you can do is walk away.
We had a similar situation in my family.
