I read elsewhere the judge told the jury that an unwanted kiss is sexual abuse. So the fix was in.

No, the aren’t. Rape is the crime of forcing someone into engaging in a sexual act. Battery is the crime of engaging in unwanted physical contact with another person resulting in harm of one sort or another.

They are not the same, they are two separate statutes in New York. Rape means forced intercourse, sexual abuse means forced sexual touching. Jury believed abuse was proven, but not rape, that’s not grounds for appeal in of itself.
Yes, you can, earlier today on FR someone posted, the judge instructed the jury that even if Trump kissed her against her will, that would be considered guilt.
Remember this is a civil trial not a criminal trial the standard of proof is not the same.
My understanding of this NY law is rape would be penetration w/ penis and she said she did not/could not tell if he penetrated her w/ anything other than his fingers. Jury believed her and her witnesses and Trump chose not to attend trial. Without his in-person testimony refuting her claim, I don’t think it’s a stretch for that jury to find Trump culpable.
Will it matter regarding Trump’s nomination? Doubtful. People believe what they believe and I don’t think this case will be anything but a few days in news cycle.. if it lasts a few days. Not saying some of Trump’s opponents won’t try to make this into a bigger story, but I just don’t think that’s going to matter one bit.

Didn’t the judge say that even if Trump kissed her he could be found guilty. Translated there was no rape or sexual assault in terms of what one woudl think of so now kissing her is sexual abuse. What a very bad joke.
