Justice Samuel Alito: I Have a “Pretty Good Idea” Who Leaked The Dobbs Opinion

Justice Samuel Alito has a “pretty good idea” who leaked the Dobbs v. Jackson Women’s Health organization draft, the Wall Street Journal reported Friday.

Alito revealed in an interview with the WSJ that he believes he knows who is responsible for the Dobbs decision leak that sparked months of protests outside conservative justices’ homes and an attempt to assassinate Justice Brett Kavanaugh, though he said that is “different from the level of proof that is needed to name somebody.”

The motive, he said, was to prevent the draft from becoming the decision: “And that’s how it was used for those six weeks by people on the outside—as part of the campaign to try to intimidate the court.”

As to left-wing accusations that the leaker was a conservative trying to lock in a favorable majority, Alito told the WSJ the argument is “infuriating.”

“Look, this made us targets of assassination,” he said. “Would I do that to myself? Would the five of us have done that to ourselves? It’s quite implausible.”

“It was rational for people to believe that they might be able to stop the decision in Dobbs by killing one of us,” Alito told the WSJ.

Nevertheless, Alito said the marshal tasked with investigating the leak “did a good job with the resources that were available to her” and said he does not feel physically unsafe “because we now have a lot of protection.”

After interviewing nearly 100 employees, the marshall of the Supreme Court said in her January findings that investigators had been “unable to determine at this time, using a preponderance of the evidence standard, the identity of the person(s) who disclosed the draft majority opinion.”

Alito also addressed increased attacks on the Court’s legitimacy, though he would not speak directly to accusations that Clarence Thomas violated ethics rules.

“We are being hammered daily, and I think quite unfairly in a lot of instances,” he said. “And nobody, practically nobody, is defending us.”

Does Alito intend to be coy and say “you’re getting warmer, warmer, oh, now you’re ice cold.”?

The threats of assassination and the intimidation by the Leftists means all of you reading this should re-examine your tolerance for the Democrats in your midst.

They are content to accept you to the extent you have to be quiet with your hands on your lap and on a short leash as at Thanksgiving or other gatherings. I ask you to not be so naive as to think they will not someday be silent when you are led into a semi to go to a concentration camp.

I believe it’s known who leaked and they are protecting the source. I am given to understand NO Justices were interviewed which suggests to me this was done so the guilty party dould not perjure themselves. It was probably decided by the powers behind the scene that a revelation like this (the leak followed by the lying) would be too damaging to the public perception of the courts (already in the toilet), but more importantly to the leftist idealogues who already occupy far too many judgeships at every level.

Not gonna happen. If anything the person will get a contributorship at MSNBC or CNN and tenure at some university after making partner at some leftwing law firm.

I know you are a good person from your posts here. I am such a kind and compassionate person myself it once led me to the projection onto Leftists in my midst that maybe they’re the same way. They aren’t, except for children and I would guess a few others. And they tolerate you only if you are silent since your beliefs are anathema to them.

As Bay Buchanan (Pat’s sister) said “My brain filters everything through politics.” As for interaction with others “politics is poison” is true for me, sadly. Living in an 85% always Dem all elections region colors my position, too.

Democrats enable the soft on crime system, BLM (watch for lawn signs), borderless overrun by illegals, teachers changing the sex of children, total suppression of freedom of speech, national control of election results counting, packing and neutering the Supreme Court, ending Constitutional rights and bringing about the “fundamental transformation” of America into a Chinese Communist/Soros/Dem style abomination.

We know this much - if the person leaking had been a Republican the corrupt thugs in the FBI would have found the person and leaked the information to 'the press' within the first 24 hours...

Then the corrupt 'DNC owned' press would have run with the story as long as democrats wanted them to run with it...

That’s conundrum for a lot of us on the conservative side.

Liberals by and large are emotion driven people and not inclined to be very tolerant of anyone with different views. They have a child-like way of ignoring reality and consequences associated with their wacky ideas. They see conservatives as outright neanderthals; irritating obstacles who are reluctant to change and help them pave the way toward a perfect utopian society based on their religion (liberalism) and love of big government.

In short, they want control, we want freedom. The two will never reconcile. And trying to reason with them is usually an exercise in futility.

Co-existing is trying, at best, but parting ways or severing ties is not really a practical matter either. That said, as a matter of self preservation its best to not forget that our liberal “friends”, relatives and associates would secretly love to see us all sent to re-education camps, if not silenced. Its worth remembering that people like that don’t respect you or your values.

While shunning is not viable, just remember who they vote for, who they viscerally dislike (hint: it’s us), and the irreparable damage their political thugs have done to this country. People who respect others are interested in finding common ground and compromising, not destroying everything to get their way. I keep a healthy distance from bad influences, toxic notions and manipulative people.

I think that Alito is prodding Roberts and making himself a potential whistle blower to trigger a Supreme Court housecleaning if Trump gets back in and the Senate goes to the GOP. If so, then a whisper to a new Trump administration could lead to an enforceable private demand for one or more Supreme Court resignations. Alito has put down quite a marker toward such a possibility.

It also sounds as if Alito is also cleverly telling Roberts to get serious about the investigation, for the sake of protecting the court’s credibility and the security of its members. In other words, if Alito has a good idea of who the leaker is then the “investigation” needs to make more effort to look harder at potential suspects.

Investigations in Washington tend not to be real investigations.

This is such a serious breech of security that the use of lie detectors should be warranted. No person is more important than the integrity of the institution IMO.

Temperamentally, if left to investigate the issue themselves, the Supreme Court as a collegial body cannot and will not authorize or conduct an investigation with sufficient rigor to get to the truth because it would implicate at least one of their own. That means that an outside investigation is needed by a new Trump Department of Justice in collaboration with a GOP run House Judiciary Committee.

It could begin by the DOJ impaneling a grand jury and calling people in under oath, with criminal charges and impeachment or forced resignation as the end point. Notably, because grand juries operate in secrecy and under special rules, they have wide scope in their questioning and little ability for those called to testify to claim immunity or otherwise refuse to appear or to answer.

As an alternative to a grand jury or in cooperation with it, the House Judiciary Committee could call Alito and his colleagues to testify publicly. That would effectively put any Justice who leaked under the threat of not just impeachment but criminal charges for perjury if they were proven to have lied under oath by denying that they had leaked or knew who the leaker was.

Alito is no fool and no doubt sees this as possible, with himself as a key witness. As with a grand jury, if asked under oath by the House Judiciary Committee, Alito and his colleagues cannot decline to answer as to whom they suspect and why.

If Trump were President and the GOP held both houses of Congress, then one or more Justices would resign if the scenario that I have outlined above were set in motion. And Alito has just told everyone that he is willing to put the ball into play.

If pressed, the result would be an upending of the Leftist bloc on the Court and in the federal judiciary at large because one of their most powerful would -- for the first time -- have been called to account for judicial misconduct. Secrets of all sorts would come spilling out about judicial misconduct on the Left because a process of reckoning would have begun.

Its true that Alito is deeply concerned about the court but Washington is all about politics, not the truth.

While the leak is a matter of grave concern in DC maintaining power and control is above all.
