A gag order for Donald Trump is 'extremely likely' once he's before a judge, legal expert says

Donald Trump can't seem to stop talking about his indictment.

But once he's arraigned, it's "extremely likely" he'll be put under a gag order, one expert said.

Punishment in New York for criminal contempt could be a $1,000 fine or 30 days in jail.

Former President Donald Trump can't seem to stop talking about his indictment. But once he's arraigned, it's "extremely likely" that he'll have to, a former senior staffer with the Manhattan District Attorney's Office told Insider.

His freedom to rant on Truth Social and say what he wants about his case at rallies will likely change once he surrenders and appears in a Manhattan courthouse, according to Duncan Levin, who is also a former federal prosecutor with the Department of Justice.

Manhattan's Acting Supreme Court Justice Juan Merchan, who is expected to arraign Trump on Tuesday, is likely to put conditions on his release, and that's "most likely" when the judge will issue a gag order, restricting Trump from discussing the case, Levin said. If Trump violates it by speaking about the litigation outside the courtroom, he could face consequences.

“The terms of bail will restrict Trump to FLA and keep him from campaigning. My fear is that is what is next.”

If that is the case, William McKinley ran a front porch campaign. Trump can too.

That’s what they want. Don’t give them what they want.

You know, at some point that argument rings hollow.

Look at the evolution of Germany in the 1930s.
"That Hitler fellow tried a coup from the beer halls."

"Don't fight him, that's what they want."

"He wrote a manifesto of hate while in prison."

"Don't fight him, that's what they want.""

"He got his brownshirt troops to rough up townsfolk and intimidate them,"

"Don't fight them, that's what they want."

"He managed to seize power with the Enabling Act."

"Don't fight him, that's what they want."

"He orchestrated the Krystalnacht."

"Don't fight them, that's what they want."

"He's rounding up Jews and Gypsies and putting them in cattle cars."

"Don't fight them, that's what they want."

"He's gassing people by the millions in death camps."

"Don't fight them, that's what they want."
At what point does this become a specious argument?

He should also have an Azov Battalion insignia.

His bail will be set at one billion dollars. As a insurrectionist and Russian Collusionist ..he is a flight risk.

Corrupt or not, they will get involved, and I feel it better be sooner or later while there is still a semblance of conservatives on the court. Last chance for the Constitutional Republic, if there is one left.

I approve of Trump showing voters the vain, bloviating sore-loser (imo) he really is now while we have time to choose a better option. I doubt a majority of voters would choose DT unless the Dems are stupid enough to run Biden again or Cacklin’ Kamala.

That basically means DJT cannot campaign. He could put in appearances, but would be forced to say nothing during those appearances.

They are going to shut him up one way or another. And that will be the prelude to shutting everyone else up as well - unless you totally agree with and spout the Democrat propaganda line of the day.

We will have to wait and see who emerges as the American Lenin, Trotsky or Stalin.

“The second will never happen. The Secret Service will never allow Trump to be imprisoned — in this or any of the other corrupt political persecutions on the horizon...”

The Secret Service is an agency of the Federal government and reports to the Department of Homeland Security, which in turn reports to President Biden. Biden and his Homeland Security secretary will tell the Secret Service to obey court orders. The Secret Service will follow the direction of its superiors, not the direction of Donald Trump.

The Constitution and federal law afford ex presidents no immunity from the legal system. Remember Donald Trump is today a private citizen and is subject to the laws and administration of justice like every other citizen. Courts muzzle and strip away constitutional rights of citizen defendants every day. The treatment of the January 6 defendants is evidence of the state of the administration of law in this country today. If Trump openly defies the judge’s orders, expect him to be imprisoned and silenced. At that point, expect the RNC, and state Republican parties, to deny him the ability to run as a Republican candidate.

Hopefully Trump has some outstanding attorneys who can advise him well as he maneuvers through a legal minefield. He will need to be very careful and running his mouth may result in imprisonment. Once arrested he is no longer a free citizen, he is subject to the arbitrary decisions of potentially a hostile judge just like the January 6 defendants who were imprisoned for 2 years without bail or due process rights. Almost certainly an indictment in Fulton County Georgia is also coming which presents even more issues.

The job of the Secret Service is to protect the former president from physical harm. The Secret Service can fulfill this function in prison by staging agents in adjacent cells. On the plus side if jailed having a Secret Service protective detail in prison may save Trump from the Epstein treatment.

Don’t be surprised at anything that may happen over the next few weeks. The judge could deny bail and put Trump in jail. Given that Trump has a residence in Manhattan, the judge can order him confined to Trump Tower with ankle bracelets as a flight risk, thereby restricting him from returning to Florida or campaigning across the nation. Recognize no matter how outrageous the actions of the judge, Trump’s case is in the New York state courts and the appeals courts in that state may be highly biased against him. Appeals courts can reject appeals. In that instance the accused or convicted citizen has no options.

Note also, once they have Trump confined they can drag the case out as long as they wish. The DA and judge will control how fast or how slow the case moves, not Trump.

Add a Georgia indictment and possibly a federal indictment, during the next few months. It is conceivable multiple unfriendly courts will make it impossible for Trump to campaign by severely restricting his freedom of speech and his movement. Whatever outrages occur in the court system, the mainstream press, and 50% of the country, will be cheering them on. As for the pro-Trump 40-50% the next few months may be a strong lesson in the power of the state to quash dissent.

And through civil disobediance, he should creatively ignore it. Maybe turn the mic over to someone else to say what he can’t say.

Thanks for taking the time to post. This is serious business and all the mad talk about what Trump should do in defiance to fix their little red wagons is just plain nuts.

Of course, then they’ll catch him “violating” it and charge him with contempt and argue he should be jailed.

There you go, have Don Jr. at the podium, DJT tells him what to say off-mic and Jr. says it out loud.

Trump usually moves back to Bedminster, New Jersey in May, so if they restrict him, it will likely be to NYC & Bedminster NJ. I think it is doubtful that they will do that though. The optics of preventing a front running Presidential candidate from campaigning would be pretty bad.
