Donald Trump can't seem to stop talking about his indictment.
But once he's arraigned, it's "extremely likely" he'll be put under a gag order, one expert said.
Punishment in New York for criminal contempt could be a $1,000 fine or 30 days in jail.
Former President Donald Trump can't seem to stop talking about his indictment. But once he's arraigned, it's "extremely likely" that he'll have to, a former senior staffer with the Manhattan District Attorney's Office told Insider.
His freedom to rant on Truth Social and say what he wants about his case at rallies will likely change once he surrenders and appears in a Manhattan courthouse, according to Duncan Levin, who is also a former federal prosecutor with the Department of Justice.
Manhattan's Acting Supreme Court Justice Juan Merchan, who is expected to arraign Trump on Tuesday, is likely to put conditions on his release, and that's "most likely" when the judge will issue a gag order, restricting Trump from discussing the case, Levin said. If Trump violates it by speaking about the litigation outside the courtroom, he could face consequences.

When you prosecute a political candidate, then criticism of the prosecution becomes protected political speech. Trump should violate the gag order, then sue the judge for civil rights violations to get the matter in front of a federal judge.
All Trump really has to do is post the Declaration of Independence..
We’ll get the hint
We learned in December 2020 not to look at SCOTUS for justice. John Roberts is a sniveling, cowardly quisling.
Is there a fine for defining the actions of a contemptable Black prosecutor and court?
The court must prove it is not contemptable
If Biden can get “80 million” votes from his basement, then Trump can get 90 from his.
If Don Jr talks in his place is that a violation?
Those words mattered when we were united but now it’s the DSA not the USA. Divided States of Amerika.
It’ll be interesting how a presidential candidate can be legally gagged. I can’t imagine this could hold up, and I doubt Trump would be capable of gagging himself (or should he)...
You don’t get the rationale? They are railroading Trump and that is just part of it.
A rally venu with wall to wall very large TV screens streaming the Trump speech made from Mar al Lago will do nicely too. There can be all kinds of denouncing the corrupt and seditious left on big screen tv
The first is peanuts for a man like Trump.
The second will never happen. The Secret Service will never allow Trump to be imprisoned -- in this or any of the other corrupt political persecutions on the horizon...
“Former President Donald Trump can’t seem to stop talking about his indictment.”
It’s kind of a big deal.
He can afford quite a few such fines. Reminds me of the old story about Abraham Lincoln being fined $5 for contempt of court. Abe handed the judge a $10 bill and turned away. The judge said, "What about your change?" and Abe said, "That's all right; I'll take it out in contempt."
That would be kind of funny if Don Jr held rallies for his father. And would infuriate the leftards.
Col Slade says take a flame thrower to the place. LOL. Watch the clip for one of the best scenes in memory.
So Joy Reid, Joe Scar, Rachel Maddow, and all the other talentless hacks who have convicted him dozens of times in the media along with Adam Schiff, Nadler, and Mad Maxine can talk endlessly about it but he is not allowed to say anything in response until he “has a chance to prove his innocence” (Pelosi)?
Sounds pretty fair to me.......
The affect will be to silence the top Presidential candidate. Stalin and Hitler are laughing from hell.
Will the judge pay him $130,000 to keep his mouth shut?
