Not a lawyer but I believe “involuntary” would be easier to prosecute and take away a lot of the excuses we have already heard (did not know the gun was loaded, gun fired itself and so on).
He failed to check the gun when he got it and then he pointed it as someone and then he pulled the trigger. The only difference between this and first degree is his intent (which would be difficult to prove).
Will he get off, perhaps, but waiting in the wings is the woman’s family who will (most certainly) file a civil lawsuit. Baldwin WILL pay a price for his action.
