If you buy a home with HOA covenants, YOU DON’T OWN OUR HOME, PERIOD.

Sure, technically your name is on the deed, and you have to pay the taxes, but you don’t own it... When others can tell you what you can or cannot do to your property, how can you remotely claim you “own” it?

I used to live in an HOA neighborhood. First thing they did to piss me off was to say that we couldn’t have a potted plant sitting in front of the house.

Is this guy wanting folks to feel sorry for him.

You bought a “rental/income property”, not a second home, in a place controlled by the locals that live there.

Bad on him for thinking that they’d allow landlords to do what they want.

The short term renters used to come in and spend like drunken sailors. It being a vacation they would bring extra money. They’d load up at the pot shops and the liquor stores because you can’t get pot in Texas, and because beer, wine, and liquor costs 30% more in The Lone Star State. They would ski at the nearby resort, because, you know, skiing sucks in Texas and they would enjoy the famous Pagosa hot springs. Imagine the rage this causes the Board. Texans in our hot springs! Gross!

Hmmmmmm....spend like drunken sailors and for damned sure act like them. Houses full of drunk and stoned Texans and I’m sure they just all sat in their rentals and meditated. I’m betting that subdivision was an unmitigated disaster come ski season. And the renters didn’t have any f**ks to give. They were there for a weekend or a week. Ski all day. Get drunk as hell and stoned to the bejesus, pack their stuff and head home. Leaving behind a train wreck. While, there were some folks there, that actually lived there, had to go to work in the morning and had a family.

My condo building also forbids short term rentals. The rationale is that it’s a security risk to have a constant influx of new strangers. The doormen won’t know who belongs.

Amazing how you all seem to be keying in the HOA and not the fact that he purchased a “second home”, that was actually nothing more than a rental property in a ski town.

A property, like all the other “second homes” that was filled with drunk skiers from Texas.

Is some of the stuff the HOA did a little excessive? Maybe. How about all of you complaining about HOAs, go find the street in some college town, known for the epic parties that are thrown in all the rentals or maybe take up residence in the area where all the fraternities are, report back and let us know how it works out.

You will cry forever.

Plenty of places to live—2nd home or not—where you do NOT have a small group of monsters telling you how to live YOUR life.

HOAs... if you’re dumb enough to buy in one or you need the company of people daily, then you get what you get. When I retired every damn real estate agent tried to get me to buy in a housing community even though my requirements were remote and no neighbors.

I finally found a nice piece of land and built. After the house was completed even the builder said they won’t be building on anymore sites like mine, they’ll stick to community building.

I lived in Pagosa Springs forty nine years ago, a small Hispanic town with only a lumber industry to support it. We lived on the road to Chama.
The vacation housing boom had just started west of town, separate from Pagosa Springs proper. Four housing lots to the acre! Way too small for me.

Last time I was through there was in 2015. I knew it had grown large when I saw a Walmart store on the south side of the road to Durango.

Wish I was still in that area, but not Pagosa Springs West.

Ok, so I want to pay extra for property that has an HOA and then pay monthly dues to a HOA board that tells me how I may use “my” property. I have never seen the allure of living in such a community.

Does your insurance handle being used as a short term rental? Are you properly permitted by the county to do so?

Just like Uber violating a lot of Taxi laws, Air BnB violates a lot of hotel laws.

No sympathy.

If the Current HOA leaders houses burn down. I expect the next batch will be more thoughtful about their approach. Just a thought. Lightning strikes are a big cause of home fires. So are idiots who run HOA doing their own home repairs.

As a residential renovation investor, I deal with HOAs or nosey neighbors (or both) just as soon after I buy my flips. It’s sexist, but I stand by it: the men are great to work with but the women are very difficult and never happy.

It’s so frequent that I’ve learned to use a little semi-charm and smile when I’ve been pushed to my limit, by saying (in a nice, sing songy way) “Mrs Neusbomb, you’d better be nice to me as I have total control over who the owners of this house is going to be...” (Just as effective: “Mr HOA Man, well you’d better tell Mrs Nueseybody that if I have any more of these nit-picky delays, I’ll just turn it into a short term rental!”)

Now, what I’m saying is total bull****, but they always buy it and they do finally back off. It’s remarkable! I imagine they think I have a list of buyers I can just pull from who might not be the right color or class level or gawd only knows... but their fear is real.

I agree HOA’s can be difficult. Pagosa Springs is a beautiful place, so there is that.

I assume that your main complaint with them is that you can’t make money off this property when you are not there, and this income was one of the reasons for your decision to purchase the property in the first place.

Is there anything else?

For a while I couldn't figure out why a regular customer shopped at a store I worked at. She had plenty of closer alternatives, always shopped in the evening, and would get nothing delivered no matter how many trips it took her in her car.

Turns out she was the president of the HOA shopping out of town buying some of the things the HOA didn't allow others to have.

Hypocrite needed to be sent out of town on a rail.
