No elections do not change the EPA’s mandate.

However the Supreme Court just did that not long ago, recognizing the EPA had exceeded its mandate:.

So you either recognize the court decision or you are not following the law. There is not a third option.

Congress has abdicated their responsibility for many years to regulatory agencies. Congress is supposed to pass laws, but it is more convenient for them to simply tell (or allow) agencies to legislate via regulation.

Trump did this too with bump stocks and despite a previous determination that they did not meet the definition of a firearm they were suddenly regulated as firearms.

There will be a court fight, over whether the stupid IRAct does give the EPA that mandate... I pray it goes our way, but I’m not certain it will.
