How much marijuana can you possess before you are assumed to be dealing?

It sounds like Biden pardoned everyone including dealers regardless of how much possession.

That's my assumption as well. Let the Democrats tell you what they did and then multiply that by 10.

Varies by state, but the amount isn’t important - what is important is the State’s AG’s view of drugs whether to prosecute or not.

But here an example of US vs other countries:

US: caught with 3 kilos of cocaine - maybe 4 years, unless prosecution is declined or plead out as is frequently the case. Fentanyl up to 1million pills - no prosecution.

Most South & Latin American countries for same offense: 5-8 years, judge’s discretion. More than 3keys, it goes to 25 years in prisons where you better have a friend or relative bring you any amenities or edible food.

I would imagine that sale of any amount is a disqualifier for this pardon.

As to how much might make them press fir delivery charges. who knows? Things like possession of scales and packaging materials might be a factor. Also, quantities in separate containers ought to be a factor. I was on a grand jury once that was hearing a case in which a guy was charged with possession of 5 bags of meth...about a 1/4 of a sandwich bag each...and they weren’t trying to get a DCS indictment. I was like “Hold the phone!” I asked why and they said they didn’t think a grand jury would go for it. Wrong.
