The propaganda given to the state-run media in the USA was that the documents "were among the most sensitive - nuclear secrets" with supposedly only 2 or 3 top DOJ officials able to look at them.
But of course, they have already been leaked to the media multiple times.
The judge should warn the DOJ - if there is one more leak to the press, it demonstrates the DOJ is fundamentally unserious - and the case will be tossed immediately.

As Trump's lawyers have already pointed out - either they are personal records or they are presidential records subject to control by the NARA. In the latter case the NARA has to get Trump's permission to release them to anyone and then go to court if Trump refuses, where Trump can assert his Presidential privilige [which he has over advice and decisions for his term[s] in office even after he is no longer President].
There is no exception for the FBI or DOJ.
What is the worst thing you can imagine them doing to Trump if they think he has the upper hand?

And what about the Presidential Records Act? This should work in President Trump’s favor as well.
The Eleventh Circuit Court of Appeals includes just Florida, Georgia, and Alabama, which obviously leans Conservative.
If the full court votes, there is an excellent chance they will uphold the entire original decision.
If just one Circuit judge handles the case, then it becomes a coin toss on every issue.
The judge should have said the DOJ had no right to the records and to return them. Stop playing games

Not to mention the lack of outrage that this same policy is responsible for the deaths of 10,000 Americans a month due to fentanyl overdoses. When has it EVER been legal that federal cops get to raid someone’s home, confiscate everything in sight, and then use only the items which pertain to their case?
This has NEVER been legal. Prosecutors are supposed to lose the use of ALL items confiscated if any of the items do not meet, not just the criteria listed in the warrant, but the criteria listed in the Constitution of the United States.

The lawsuits against the feebles as a result of the special master review should more than compensate for Trump's upfront cost.
