Former Trump national security staffer Kash Patel called in with Martha Maccallum on FOX News on Friday to react to the release of the warrant used by the FBI to search President Trump's Mar-a-Lago resort home.
"If he says something is declassified, that's it, it is declassified," Patel explained. "He declassified a whole set of documents that should have come out... That's on the National Archives to sort that material out... Even if it was classified, they'll never meet the burden of intent because the president didn't pack it up and take it out himself, the G.S.A. has said they did it and they made a mistake."

That's exactly how today's National Review podcast explained it in their defense of President Trump.
If any of this winds up in court, all President Trump has to say is, "I declassified it before I left office." and that's the end of it.

Yes, and Kash Patel has stated that he was there when PDJT declassified the docs so there is an eye witness ... which is totally unnecessary, no witness is needed, but there is one.

The GSA might have made a mistake, or maybe even put something incriminating into these papers.
But one doubts that Trump read each and every document in those 16 boxes before they were packed up.
As for secret and top secret material: A lot of nonsense is listed as top secret by some bureaucrat who likes pushing his authority.
One does wish Trump had scanned all of these documents and since Assange is in prison and other whistle blowers are in Russia, he should put them up on the pirate Bay for all to examine. (end sarcasm).
By definition, if they are at Mar-a-Lago they are unclassified.
I think he is incredibly incompetent and this raid on Trump has exposed it in spades.
The U.S. dodged a nuclear bullet when his SCOTUS nomination was scuttled. What a disaster that would have been.
But it also can't just be an ex-President saying "oh yeah, I declassified that back when I was President."
He can say it’s declassified and it immediately is. But then a whole bunch of ppl/agencies have to sign off on it to make it “official.” The papers were pry related to the FBI shenanigans surrounding Russiagate and Jan. 6th so of course they’ll never get around to officially declassifying them. In fact, they want them destroyed so they can’t be exposed. So technically Kash is correct. And I’d believe him before I’d believe anything coming out of Bret Baier’s mouth.
Those lines are already drawn.

They’ve thwarted him at every step along the way since then. He didn’t play ball with them from the beginning and was threatening to break up the Deep State. He cannot be allowed to survive, at least politically.
Recently, they’ve seen the power he still wields over the GOP so they’re trying to take him down permanently now.

Doesn’t matter anymore. The FBI and DOJ will fabricate whatever they need to lock up Trump until at least 2025. The precedent is set with the January 6th prisoners. My fears. Trump will be arrested, charged, thrown in solitary confinement (for national security reasons of course), without bail (because he is a flight risk heading out to Russia, of course) and he will rot for a couple years when either a phony conviction is made by a trial before a single judge for some invented crime he didn’t commit.

This will not end well.
What evidence? That his subordinates followed his orders and changed the classification markings? That’s on them, not President Trump.
If he said he declassified something, then he did just that. He was the president. He’s not beholden to some office drone who might’ve been like, “It’s Friday afternoon and this is a lot of paperwork. Looks like a Monday problem.”
But, we are in uncharted territory here because, as far as I know, the Presidential Records Act has never been enforced against a former president, and certainly not in the manner of a FBI raid.
So I suspect when push comes to shove, the exchange is going to look like this:
”I declassified these documents.”
”Prove it.”
At which point, Donald Trump needs only to refer to the powers granted to him in the Constitution as the Chief Executive.
Even if there was no documentation, a declaration that a classified fact is now no longer classified is not invalid. The fact of declassification just becomes more difficult to prove.
Where a lot of this falls into the "there is a process that has to be followed" is that when you declassify one thing, it is very likely going to cascade into a whole bunch of other things being declassified. Updating those markings comprehensively is a hugely difficult and manually intensive job to do and unless you can draw a nice little circle around everything that is now no longer classified, it's impossible to do accurately. You are also obligated to treat classification markings as accurate unless you have direct evidence otherwise. That's one of the reasons why stuff sits in this sort of limbo world of "possibly declassified but not officially declassified."
If you really want to bake your noodle, a subsequent President could decide "you know what, that guy was wrong" and reclassify stuff that was previously declassified. If the information hasn't gotten out to the public (and because the deep state can withhold and slow walk FOIA information that falls outside of the classified world purview, that happened all the time in the Trump administration), it's like the declassification never even happened.
Now if you think that's bulls###, that the system is rigged, and there's no real accountability, of course you'll understand when someone points out that this was the whole point all along.
