If Trump declassified the documents prior to leaving the WH then evidence should exist on the documents themselves or in some place to show that the declassification occurred.

Not even sure that classified materials is what this is all about other than to generate headlines. I suspect they were looking for something specific.

Perhaps an FBI version of the Sandy Berger deal.

It has to be done while he still holds the title, not post-presidency.

Just use your brain. If the President wants to nuke Russia if the Russian President of Ukraine goes into Ukraine that could be classified as Top secret. If he goes to a summit with Russia, talks to The Russian President it makes no sense that he would have to ask anyone below him if he can divulge that info it’s the Presidents strategy.

“When Republicans have control in January we move for the immediate impeachment of Attorney General Garland and FBI Director Wray.”

Hope you are correct about that. Right now I have absolutely no faith in any politicians other than hearing them run their filthy mouths off.

Having said that..if they have ANY little tiny bit of decency left, they should impeach the whole GD works and McCarthy becomes the defacto leader of the country...if the republicans get the house and senate that is.

Kash Patel: All The Documents At Mar-a-Lago Were Already Declassified Unilaterally By President Trump

Should make for a short legal proceeding then. Patel says they were declassified and the warrant says they weren't. See what the judge says.

According to Brett Baier on Fox, Trump cannot just “wave a wand” and declare papers declassified but there is a process that has to be followed with a paper trail.

De-classifying a document for regular people typically means that the original classifying authority (i.e. the people that declared it classified int he first place) have to say it's no longer classified. But the President is above all of them so normal policies doesn't apply to him. He can do as he wishes and nobody below him can constrain him with a policy that they wrote.

One thing I've noted in recent years is the propensity to overclassify things. By that I mean if you read the security classification guidance associated with a thing it will tell you what is and isn't classified but it you look at documents you will see many that clearly aren't classified (per the guidance) marked as classified anyway. I tend to think it's to keep them from being subjected to FOIA or something and it's a problem because it really hinders the ability for people to share information. But if you want to get that document properly marked as unclass you need to get the originating authority to agree to it, which is a pain in the rump and they usually won't bother anyway. Nobody wants to stick their neck out in government.

https://en.wikipedia.org/wiki/Bret_Baier

“Baier then attended DePauw University in Greencastle, Indiana, graduating in 1992 with a BA degree in political science and English.”

https://en.wikipedia.org/wiki/Kash_Patel

“After graduating from law school, Patel worked as a public defender in Florida for eight years, first in the Miami-Dade County public defender’s office and later as a federal public defender. As a public defender he represented clients charged with felonies including international drug trafficking, murder, firearms violations, and bulk cash smuggling.

In 2014, Patel was hired as a trial attorney in the United States Department of Justice National Security Division, where he simultaneously served as a legal liaison to the Joint Special Operations Command.

During this period he was embedded with a special mission unit at a “secure facility” and, in 2015, received a commendation from the Central Intelligence Agency. In 2017, Patel was appointed senior counsel on counterterrorism at the House Select Committee on Intelligence.”

So which one do you think has a better handle on the law, Brett Baier or Kash Patel?

But how does every other President get their stuff cleared by NARA, and Trump cannot manage it? It’s not like this is an unusual process.

Remember earlier today when you told me not to believe everything being asserted? We don't know this is true.

Also, has the Federal Bureaucracy ever hated a man so much as they hated Trump? They may have hated Reagan almost as much, but back then, even the liberals were a bit more honorable than they are now. Daniel Patrick Monihan comes to mind.

It seems like everyone around him is incompetent.

That wouldn't be my first guess. They were trying to f*** him over in every possible way of which they could think. He was the foreign pathogen that the body of Washington DC was trying to eject.

If he took them with him, wasn't he president until he left?

January 20. Did he stick around in the White house after that date? I don't think so.

Ergo, when he took them, he was still president.

We could likely get the House vote necessary for impeachment. Where is the 2/3’rds Senate vote going to come from for removal? Without that its a note home to their respective mothers that they’ve been naughty! IMO without a reasonable shot at a conviction hence removal its a waste of time and money. John/Joan Q. Public will view it as such thus more political kabuki theater. They won’t be completely wrong!

I think it would be great if his closed circuit system had
sound, and the FBI was there giggling about fondling
Melania’s clothes, and saying other things that
incriminated them.

Can you imagine when those clips hit the media?

When Trump returns to the Oval Office, I suggest he turn
the power off at the FBI and BATF buildings.

Then, while they are scrambling around to find out what
happened, they hear him on the radio making a short
speech where he tells the nation those agencies no
longer exist.

I’d also have a sharp team of crack individuals, breaching
the FBI to freeze the activities and documents of certain
FBI employees that are known to have been working to
hinder Trump’s administration and personal life.

I’d have my new Attorney General immediately file charges
against Garland and Wray and anyone else who had done things
that needed to be addressed in a court of law.
