Congress referred it to DOJ which does have executive powers to execute an arrest, albeit in this case these powers are being abused.

Brandon’s Justice Department acted quickly to indict Navarro after the democrat House voted him in contempt of Congress. Oddly enough Obama’s Justice department declined to indict Holder when he was voted in contempt of Congress.
