National Guard members can unionize if and when they’re called up by governors

National Guard members on state duty can now unionize, thanks to a new Justice Department agreement. A 1978 law forbids military personnel on federal duty from unionizing, but labor unions in Connecticut filed a lawsuit against the DOJ and Attorney General Merrick Garland seeking the right to collective bargaining for National Guard members on duty ordered by the governor. DOJ settled the case on Tuesday. (Federal News Network)

This is insanely stupid and Garland should be forced to resign immediately for this dereliction of the office.

It also opens the door wide open for communist infiltration of our troops. What are they going to do - go on strike when ordered into a war for capitalist aggression?!

The National Guard called up by governors are state militias and subject to their respective state laws. The DOJ and the Attorney General have no authority to make regulations regarding them. As the commanders in chief of their respective state militias the governors should tell the federal government to go pound sand.

Yep. If you live in a disaster-prone area, good luck the next time a hurricane or major flooding strikes. Don’t count on the National Guard to actually show up to help.

No, if they are on Federal duty, there’s no union. It’s only when they’re taking orders from a state governor that they can unionize. It’s nice that the Federal D.O.J. decided to settle with the unions. I’m sure they consulted with the 50 state governors while making this decision. /s
