I see this as simply setting up situations where gas station operators are punished with legal fees defending themselves in court over baseless accusations of “excessive”.
It does not define what excessive means on purpose, and I see it as the opposite of "toothless". It means whatever they say it means, which may or may not have anything to do with what it meant yesterday or will mean tomorrow.
